Common Questions to Ask an Accident Attorney After an Injury in Orange County

These are all fundamental questions injury victims should ask their Orange County plaintiff lawyer. Before entering into the contract, ensure you understand the time to settle or go to court and the fee structure in your case.

How much do personal injury lawyers charge in Southern California? Most Orange County injury law firms work on a contingency fee basis, so you won’t be charged if your case isn’t successful. This is very important because most have already suffered severe financial setbacks.

Can I handle an injury claim myself? You can handle your own injury claim. Still, the process typically tends to be long and complicated, and getting the best results usually requires extensive negotiating skills and money to advance.

Do most personal injury claims settle out of court? Most injury claims are settled, although some will require going to court. Our Orange County personal injury lawyers are seasoned trial attorneys, ensuring your case is never handed off.

What is the percentage a personal injury lawyer charges? Depending on the resources involved in the accidental injury claim, the attorney’s fee will typically be 33% of the amount recovered. Those accident claims requiring more resources (experts, evidence safeguarding, etc.) can charge more to offset the costs to the law firm.

How do law firms get paid in injury cases? We are only paid after you are paid. Since a personal injury law firm works on a contingency fee basis, they only collect their fees upon settlement or verdict in your accident case.

What is a typical injury case in Orange County, CA? A typical Orange County injury case is a traffic accident, slip and fall, or dog attack. There are other less common types of injury claims, like auto defects and dangerous products. Some personal injury claims involve litigation.  An injury accident law firm specializes in these cases and nothing else, making them outstanding trial lawyers.

How long does it take to settle an injury claim? Settling your Orange County injury claim can take six months to two years. Client cooperation is also necessary to expedite your case. Our team will stay on top of the defense team and insurance adjusters to settle your claim as quickly as possible while protecting your financial interests and providing the best injury compensation.

Who will pay my medical bills and hospital costs? When you retain our law firm, we work to put your medical bills on a lien so that you won’t have to pay them until your case settles or goes to trial. Taking medical costs off the table while you recover is paramount to your financial well-being.

Will I recover more money if I hire an injury lawyer? On average, you will recover more by hiring a top-rated Orange County personal injury lawyer than by handling the case yourself. The amount of resources they have at their fingertips, coupled with years of experience, almost always results in a higher payout than if you were to take on the case yourself. Proven success in winning tough cases is where the strength lies in a solid, serious injury claim.

Do I have to pay the accident attorney upfront? Most injury and accident attorneys work on a type of lien wherein they are not paid upfront. Legal fees are applied as your case is worked on, and the attorney takes their cut upon settlement. This is not how traditional attorneys in criminal or civil cases work. Those types of attorneys do charge up-front fees.

What should I look for in hiring an injury attorney? Finding the best personal injury lawyer is paramount to the success of your accident claim. Look to find an attorney with zero negative issues with the California Bar. Check out the attorney’s reviews and see their awards and honors in the legal field. A stellar reputation in the industry amongst other injury attorneys and legal professionals is paramount to trusting your lawyer.

Navigating the legal system in California after an accident can be a minefield. But at Bisnar Chase, we are here to make it easy for you. Consulting with a qualified Orange County personal injury lawyer can benefit personal injury cases and its success.

If a drunk driver crashes into another car and causes injuries, they may be arrested and face criminal charges, but they could also face a monetary lawsuit. That is where we come in. We are very successful plaintiff injury lawyers serving Orange County and Southern California injury victims and winning complex legal cases.

A large number of accidents and injuries happen every day in Orange County, CA. It is a significant area with 34 separate cities, including Anaheim, Huntington Beach, Santa Ana, Newport Beach, and Irvine. These cities cover a massive 950-square-mile area of Southern California.

Types of personal injury claims: Tort and Contract

Understanding the basics of California injury law is essential to ensure you are doing everything possible to protect your rights. There are two types of injury claims: tort (also known as negligence) and contract.

Tort claims involve situations in which you have been injured due to someone else’s careless or reckless behavior. Contract claims include documents in which you have signed an agreement with another person that creates an obligation on both sides to act in a certain way.

Once you’ve identified the type of claim, the next step is to decide who will represent you: you or an attorney. It is important to remember that only you can determine who will represent you in court, and it’s your decision that represents you.

A serious accident lawsuit is a type of civil claim. It involves the plaintiff (the injury victim) filing a claim against the at-fault party (the defendant) whose negligence has caused the accident, known in legal terms as the defendant. Personal injury lawsuits result in a financial award to injury victims, typically after serious or catastrophic injuries.

Filing an accident claim in Orange County ensures the injured party is financially compensated. No one should be left out of pocket and suffering if they have been injured in an accident through no fault of their own.

There is a time limit to file your personal injury claim

If you have been hurt in an auto accident or other injuries, turn to the Orange County car accident lawyers of Bisnar Chase for help. There is a time limit of two years (statute of limitations), so reach out to us for a free consultation and legal advice sooner rather than later.

There was also an update to the law in California in January 2023:

Time-Limited Demand Statute: This statute was updated in January 2023 and requires a plaintiff to provide a written demand for settlement to the defendant before filing a lawsuit. The defendant then has 45 days to accept or reject the demand. Your accident attorney will be aware of this and act accordingly.

"The amount of time you have to file an injury claim: Under the California Statute of Limitations Civ. Proc. §335.1 those looking to file a personal injury incident have "Within two years: An action for assault, battery, or injury to, or for the wrongful death of an individual caused by the wrongful act or neglect of another. "The statute of limitations for minors may vary depending on the state the injury occurred in."

Did you Know? No seat belt, no case!

What Documents Are Required to File a Personal Injury Claim in Orange County?

The following paperwork will be submitted in an Orange County personal injury claim:

  1. Summons: This serves as notice that you are suing the defendant.
  2. Complaint: Covers the accident’s specifics, your injuries and damages, and your dispute with the defendant’s insurance provider.
  3. Civil coversheet: This document describes the type of case being filed with the court.
There are different cause of action forms based on the accident: negligence, motor vehicle accident, intentional tort, and premises liability.

You can see the full schedule of required documents at the OC Courts. (PDF). The lawsuit will be filed in the venue where the defendant resides or where the injury happened. If you still have questions about the legal documents you need, call a personal injury attorney at Bisnar Chase at 949-203-3814 for a free evaluation.

Common Injury Accidents in Orange County, CA

Common types of accidents in Orange County California

Our personal injury attorneys in Orange County take on various negligent cases. People can be hurt anywhere, from crossing the road to slipping on a wet store floor. We have been based in California for over four decades, with an office in Newport Beach, and have built up a significant level of expertise and years of experience.

Some of the most common accident claims that we take include the following:

Car accidents: Car crashes happen daily in Orange County. California has one of the highest collision rates of any state, and OC is statistically one of the most dangerous areas.  Auto accidents can cause anything from minor injuries to fatalities. We also handle other motor vehicle accidents, including motorcycle, truck, and parking lot accidents.

Dog bite injuries: About 4.5 million dog bites occur across the US annually, and California routinely has the most dog attack incidents. The American Veterinary Medical Association reported that each year, 800,000 people require medical attention due to dog bites, and Orange County streets, parks, and beaches are always packed with dog walkers.

Slip and fall accidents: The impact of a fall after a slip or trip can leave people with significant injuries. Common slip-and-fall locations include public settings such as pools, restaurants, bars, or grocery stores. The property owner or manager has a duty of care and could be liable for injuries.

Class action lawsuits: A group of people with the same legal claim file class action lawsuits. Types of class action cases typically involve employment law or defective product claims.

Product liability injuries: People injured while using a consumer product can file an accident injury claim. Injury victims who have suffered harm due to a poorly designed or manufactured product or a defective product that malfunctions can file a product liability lawsuit with the Orange County courts.

Truck accidents (Semi-truck, Commercial trucking): Big rigs and semi-trucks are familiar sights in the OC, supplying many businesses across the area. But they are also huge and heavy vehicles that cause significant damage when they are involved in collisions.

Pedestrian and cycling accidents: Many accidents involving pedestrians and cyclists occur in Orange County, especially in coastal cities such as Huntington Beach and Newport Beach.

Hoverboard, e-bike, and e-scooter accidents: It is not just traditional bicycles that are involved in accidents. More and more incidents are now involving high-tech modes of transport, such as electric bikes, e-scooters, and hoverboards, known as micro-mobility devices. Injury accidents involving electric scooters and bikes can have deadly outcomes.

Employment law: We handle injury claims and help Orange County employees who have been mistreated. Call us for wrongful termination, harassment, wage and hour theft, and other workplace complaints.

Wrongful death: In catastrophic injury cases, a person will die due to somebody else’s negligence. In these instances, surviving loved ones can file a wrongful death lawsuit in Orange County to seek compensation for their enormous loss. This can help with medical costs, loss of companionship, and loss of income.

Medical malpractice (Limited): Our Orange County attorneys handle legal cases involving healthcare providers (such as doctors and nurses) who have failed to provide reasonable patient care, resulting in injury or harm.  These medical malpractice cases are evaluated case-by-case, as we do not take all medical malpractice cases into account. We also take on negligent facility injury cases and have California’s largest jury verdict ($11 million) for this type of injury.

Other practice areas: We investigate the incident, gather evidence, and represent the injury victims in court or negotiate with the defendants to reach an acceptable injury settlement.

Our top-rated injury lawyers have extensive knowledge of medical procedures, state and federal laws, and California court procedures. Our team of individuals works to help our clients obtain justice, financial compensation for their injuries, and, sometimes, policy changes so that negligent errors don’t happen again.

The above are just some of the common cases we deal with. A few others include:

  • Auto defects
  • Hit-and-run accidents
  • Traffic accidents (car, truck, scooter, motorcycle)
  • Swimming pool injuries
  • Catastrophic motorcycle crashes
  • Bus incident
  • Boating accidents
  • Bicycle accidents
  • Medical malpractice (limited)
  • Work-related injuries (non-worker’s comp)
  • construction accidents (workers)
  • Electrocution accidents
  • Assault and battery (limited civil, not criminal)
  • Public transport collisions
  • Amusement park accidents
We do not handle workers compensation cases; however, if you have an injury on the job that is not related to workers compensation, we may be able to help you.

This might be a delivery driver who sustains harm while operating a company vehicle or a construction accident that qualifies for a personal injury claim, not workers comp. Some construction accidents don’t fall under worker’s compensation and may be handled by a personal injury law firm.

You do not have to suffer financially due to someone else’s negligence. Please speak to our personal injury lawyers in Orange County today to maximize financial compensation, including medical attention. What Are the Most Common Types of Injuries?

People are injured every day for a variety of reasons. From bicycle accidents to more serious injuries like motor vehicle accidents, many are typical, and some are catastrophic, including:

  • Spinal cord injury
  • Head or brain injuries
  • Back injuries
  • Neck injuries (whiplash, fractures)
  • Hip and knee injuries
  • Traumatic skull injuries
  • Internal organ damage
  • Herniated disk injury
  • Broken bones and sprains (arms, ankles, legs)
  • Emotional distress and trauma (PTSD)
  • Soft tissue injuries
  • Nerve damage
  • Poisoning (chemical/food)
  • Bruising (severe and minor)
  • Burns and fire injuries
  • Catastrophic injuries
  • Disfigurement and scarring
  • Significant injuries to the eyes
  • Puncture wounds and infection
  • Surgical errors, medication errors
  • Electrocution trauma

It’s imperative to seek medical attention immediately after a serious accident. Not only to ensure you are okay but to preserve evidence of your Orange County personal injury.

Physical injuries may be apparent, but the mental toll of being involved in an accident often does not immediately show. It can take years to overcome the fear and anxiety associated with an accident.

Insurance companies will not be your advocate; they collect premiums and limit payouts.  Insurance adjusters are rewarded for limiting the amount they pay on an accident claim and will try to settle your claim quickly before you have time to consider filing a lawsuit.

Legal representation and even court litigation will ensure you are fully advocated for and protect your current and future earnings from your settlement.

Whether your injuries are serious or minor, it’s best to have a seasoned Orange County personal injury lawyer review your evidence to see how valuable your case may be.

What is Your Orange County Personal Injury Case Worth?

California injury law covers a wide range of accident and injury types. The amount of money awarded to a client in monetary compensation for an injury case will always depend on how they were hurt.

Bisnar Chase is a plaintiff’s law firm focused on pursuing justice. We will fight to make sure you get the monetary reward you deserve.

These are some of the factors that affect the level of remuneration a person might get in Orange County personal injury cases:

  • Pain and suffering
  • Medical bills, hospital fees
  • Lost wages and future earnings
  • Impact on future employment opportunities
  • Economic and non-economic damages
  • Property damage
  • Loss of enjoyable life
  • Emotional trauma and distress
  • Ongoing care costs

These factors could impact the amount of money you could be awarded in your injury case through a settlement or jury verdict. Injury compensation is meant to make you whole after an accident, covering losses. This includes lost wages if you cannot work during recovery, medical expenses, treatment costs, and much more.

Working with an Orange County personal injury lawyer will ensure that you maximize the amount of financial compensation you can receive and that your financial interests are protected. Our team is made up of legal experts who have the experience and skills to win your case.

How to calculate personal injury damages

In personal injury law, damages refer to a monetary reward for losses and harm caused by the negligence of another party. These losses can include medical bills, lost wages, and other costs associated with physical injury or loss of property.

In many cases, these damages are calculated using a formula that considers the injury’s severity and the value of lost time from work or school. Damages can also be awarded based on pain, suffering, and other factors such as mental and emotional distress or loss of companionship.

In injury cases, damages are usually an essential part of a settlement agreement between the parties involved. To calculate damages in an injury case, you must determine the cost to replace your belongings, pay for your medical bills (including future care), repair your damaged car or home, and replace any stolen property.

This can be difficult because each situation is unique, and different experts may weigh in on what’s considered fair. Fortunately, your attorney can tell you what they anticipate your recovery will be based on similar cases they’ve handled over the years.

Injury compensation calculations will always be based on the economic losses: the amount of your loss, future loss, and your overall pain and suffering,  lost wages, mental anguish, etc. Our Orange County personal injury lawyers can review your claim and determine how much in damages you are entitled to.

What is PIP? (personal injury protection)

Personal injury protection (PIP) is a type of car insurance that can help cover medical costs for injuries sustained in an accident, no matter who is at fault

If you are injured in an accident, you can receive help from the PIP portion of your car insurance coverage. It covers expenses such as medical bills, lost wages, and rehab costs. It also covers burial and funeral expenses as well as living expenses for items you cannot pay for because of your injury.

PIP coverage is not required in all states. You can see which states require it here. California does not require PIP coverage; however, take into account if you caused an injury or were injured in another state. PIP payouts are available regardless of who was at fault.

Personal Injury Protection does not cover vehicle damage, property, or bodily injury to the other driver or passengers.

Personal injury vs. bodily injury

A bodily injury is any physical injury that results in some body damage. Examples of bodily injuries include broken bones, cuts, and sprains. A person who sustains a bodily injury is said to have been injured. In contrast, a person who sustains an injury to their personal property is said to have suffered injuries.

Personal injuries are very different from physical injuries because they refer only to property damage. If a person suffers an injury, it can be difficult to determine what part of the body has been damaged. Because of this, personal injury cases often require medical experts to assess the damage’s extent and determine the injury’s precise nature.

Property cases involve more straightforward issues, such as determining whether someone was at fault for causing an accident or how much damage was caused.

Personal injury compensation without a lawyer?

It is possible to handle your own personal injury case; however, if it is not an open-and-closed simple case, you may leave money on the table.

Part of a successful injury claim is discovering elements of the case that will improve compensation. Many people who do not practice injury and accident law will miss these opportunities and lack the skills to be tough negotiators.

A personal injury case can take up to two years to settle, and if it needs to go to trial, you would have to hand off your case to a law group or represent yourself. All of our Orange County personal injury lawyers are trial attorneys.

Can I go on disability after I’m Injured in California?

If you have paid into disability in the state of California and are injured, you can apply for disability. Your medical team and primary care doctor will decide whether it is a long-term disability or a short-term disability.

As long as you are under the care of a physician who reports your disability, California will cover you for the disability you have paid into. Your employer may have also provided you with a long-term disability plan if you paid into it.

Speak with your doctor if you need to file a disability claim, as they will need to provide documentation and evidence of your disability. Call an Orange County personal injury lawyer to review your injury and disability benefits.

What is Medpay and UIM coverage?

In California, this might apply to your situation as an injured plaintiff:

  • Medpay (Medical Payments Coverage): Covers medical bills regardless of who is at fault for the accident. This applies to injuries sustained in various circumstances, such as while driving your car, riding in someone else’s car, or even when a vehicle strikes a pedestrian (policy specifics may vary)
  • UIM (Uninsured/Underinsured Motorist Coverage): Kicks in when the at-fault driver has no insurance (uninsured) or not enough insurance (underinsured) to cover your damages. Protects you from medical expenses, lost wages, pain and suffering, and other damages. You must exhaust the at-fault driver’s liability coverage first (if any).

Remember, this is a simplified explanation. Consulting with a personal injury attorney in California is highly recommended for specific legal advice regarding your situation.

Important Steps to Take After an Accident

When you suffer an accident, it can feel like the world is falling apart. You might be unable to work, which means you won’t be able to pay your bills or buy groceries. You might be in so much pain that getting through the day is challenging.

Your activities are limited, and you may not even be able to get out of bed for several days after the accident.

Many things go through your mind after suffering a no-fault injury.

  • How will you manage financially?
  • Will your insurance company cover the cost of extensive medical treatment?
  • Do you have enough personal liability coverage to protect yourself?

If you’ve just been injured in a traffic accident, you may not consider how this will affect your long-term financial future.

But it’s essential to take immediate action after being hurt—whether a car, truck, motorcycle accident, slip and fall accident, or another type of injury—to protect your future and ensure you’re financially protected.

Seek medical treatment immediately:  Many people injured, whether in traffic accidents or a slip-and-fall incident, will downplay the severity of their harm.  This is not a wise or safe thing to do. Sometimes head injuries and traumatic brain damage can happen without the injured victims realizing it.

It is vital to seek appropriate treatment after an accident, no matter how minor you think your injuries are. This has dual benefits. Most importantly, it ensures the injury victims are safe and properly treated.

But it also provides proof of injury if a legal claim is filed. Once the injured person has been adequately treated, they can gather evidence and consult experienced personal injury lawyers in Orange County to take on their case.

Compile evidence from your accident: When you or a loved one are involved in an accident, you want to gather as much information as possible, whether from the driver who hit you in an auto accident or a dog owner in an animal attack.

For example, if a driver injures you, collecting a driver’s license number, car registration number, vehicle VIN number, and driver’s insurance policy number will better support your claim. You would also want to have physical evidence of what occurred.

Pictures and videos and collecting witness statements can help prove what happened. Find as many witnesses as you can to strengthen your accident claim. The most important part of your accident claim will be evidence.

If there is no way to prove you were the injured victim, the case could be difficult. But an Orange County personal injury lawyer specializing in nothing but accident law will uncover ways to reveal more evidence to support your lawsuit.

Write down and document everything: It would help if you wrote down the name of the doctor or nurses who treated you, the prescribed medications, and the dates and times you went to the medical facility.

You should write down the names and contact information of the people who helped you after the accident. This includes family members and friends, doctors, and paramedics.

You should also write down any emails, texts, or phone calls related to the accident from the police department, defense lawyers, and insurance adjusters so that you have a record of them in case you need to refer to them later.

Find an Orange County personal injury lawyer: Dealing with an injury-accident claim alone can be a nightmare. We have seen people try to do it, turning to personal injury lawyers later when the process becomes overwhelming. Trust a professional with your claim. Our trial attorneys will build a strong case and handle all filings and negotiations.

You could also:

  • File a police report for investigation
  • Notify your insurance carrier
  • Request related medical treatment records

Evidence Needed to Win an Injury Claim in the County of Orange

While we handle every aspect of your case, you need to focus on recovering from your injuries. It is important to attend all doctor's appointments, take the prescribed medication, and follow up with the physical therapy instructions.

Failure to do so will not help you receive the maximum amount of compensation. If you do not follow your treatment plan, your injury lawyer will not have medical documentation stating that you are still hurt and recovering from the accident. Our top rated personal injury attorneys in Orange County are familiar with all OC courts and defense teams.

Winning your case is our ultimate goal. To do so, your successful injury lawyer will build the most robust case possible and establish clear liability. It is best to support your Orange County legal claim with as much relevant evidence as possible.

  • Accident location evidence: A clear account of the incident, including the location, those involved, what happened, and the time. Write everything down as soon as possible while your memories are fresh.
  • Police reports: A copy of your police or accident report, if applicable.
  • Medical records: Medical records and documentation of your injuries; these documents show the nature and extent of your injuries and all the treatment you have received.
  • Eyewitnesses: Witness statements and their contact information. Witnesses are critical to putting together the timeline of the personal injury accident.
  • Visual evidence: Photos and videos of the incident, injuries, those involved, etc. These images can be used to show the scene of your accident, your injuries, and any property damage.
  • Expert testimonial: Experts in the field of accident reconstruction can provide their opinion on the cause of your accident, the severity of your injuries, and the cost of your medical treatment.

We will add to this evidence expert testimony, medical experts, and anything else required to win your case.

Making a solid injury claim: To win personal injury cases in California, you must prove the following four elements with a preponderance of the evidence:

  1. Duty: The defendant owed you a duty to act with reasonable care. This means they had a legal obligation not to act in a way that could cause harm to you. A large part of an accident and injury lawsuit is proving negligence or intent.
  2. Breach: The defendant breached their duty to act with reasonable care. Being reasonable is expected in a civilized society. The duty to act reasonably and responsibly is applied in an injury case.
  3. Causation: The defendant’s breach of duty caused your injuries. This means that your injuries would not have happened if the defendant had acted with reasonable care.
  4. Damages: You suffered actual damages as a result of your injuries. This includes economic damages (such as medical bills and lost wages) and non-economic damages (such as pain and suffering).

Building a solid injury claim will involve all of these elements, and an experienced Orange County personal injury attorney has the deep pockets and resources to take on challenging cases.

All we ask of you is that you follow our legal advice and continue with medical treatment if needed. Most PI injury claims fall apart because the plaintiff stops seeking medical treatment.

We’ll take care of everything else: reviewing and requesting all records, setting up the demand, negotiating with the insurance companies and defense team, and filing the lawsuit.

We will also work to get medical liens and reduce your medical costs (hospital, emergency, therapy, etc.) so that you keep more of your settlement.

Dealing with the Car Insurance Companies

You may have to deal with insurance companies when you claim to have suffered an injury in Orange County. After an accident, you will often make a claim or seek a settlement from the at-fault party’s insurance company.

Insurance adjusters will usually be pleasant and personable, but their job is to settle cases quickly and for the lowest amount possible. They will use any information you give them to do this.

The best option is to call our Orange County personal injury lawyers and let them handle all insurance carrier negotiations for you. However, if an insurance agent does call, you can use the tips below:

  • Be polite and calm: The best thing you can do while speaking to an adjuster is to be pleasant. You can decline to speak before talking to your lawyer, but be calm and courteous.
  • Understand who you are speaking to: Do not go into a call blindsided when the insurance company contacts you. Collect the adjuster’s name, contact, position, and company they are calling from first.
  • Do not give too much information about yourself: You only want to give basic information about yourself, such as your name, home address, and cellphone number. You do not need to get into the specifics of your injuries and the circumstances of an accident without speaking to an injury attorney in Orange County, CA.
  • Do not give in to the pressure to settle: Adjusters usually try to settle a claim by the first call. This is due to the adjuster wanting to close the case and move on to the next. Insurance adjusters will also want you to settle for less than you deserve. You do not need to agree to anything at this point.
  • Say no to the call being recorded: If a call is recorded, it can be used as evidence throughout the claim, even if you misunderstood a question or said something you did not mean. You are within your rights to refuse a call recording and should do so.

Questions insurance adjusters try to avoid answering

  • How much can I collect in my Orange County injury claim? They will try to avoid this at all costs.
  • Do you have the authority to settle my claim? They usually have a small limit, and anything over that has to go to a supervisor, so they’ll try to keep your claim within their limits.
  • If I seek treatment, will you settle my case faster? The insurance adjuster doesn’t want you to have ongoing treatment and will not tell you how to add more value to your claim. They will not assist you in potentially adding more value.
  • And they will never advise that you may need a lawyer to maximize your claim.

Do not discuss this with insurance agents—either your own or those representing an at-fault party. Let our Orange County personal injury attorney talk on your behalf to protect your case.  Free consultation. Call 949-203-3814

Mutual Fault in Traffic Accidents (Comparative Negligence)

Comparative negligence is the concept that parties can share responsibility for each other’s damages in certain situations.

In most states, comparative negligence means that a driver who crashes into another vehicle can be held liable for any damage caused to that vehicle, even if the driver was at fault for the accident.

There are two types of comparative negligence: absolute and relative. In cases where an injured party is found at fault, absolute comparative negligence refers to the degree of fault.

For instance, even if your policy covered the damage, you could still recover from your neighbor’s car insurance carrier if you had a collision with their vehicle.

In another example, if you are involved in an accident while driving 75 mph on the highway and cause $10,000 of damage to another driver’s car, your own policy will not cover those damages.

However, in a relative case, both drivers would only be liable for their proportional share of the total damages because both drivers were at fault for some role in causing the accident.

Suppose you are found at fault for an injury or property damage incident. In that case, you may be able to hold someone else liable for those damages under comparative negligence.

In most cases, no one will be considered 100% at fault for an accident based on their actions alone. Comparative negligence only refers to what percentage of fault you hold compared.

Partial Fault in an Accident Lawsuit

Can you still file a lawsuit if you were partly at fault for an accident or injury in Orange County? The simple answer is yes. OC falls under California state law. As such, it uses comparative or contributory negligence laws.

Comparative negligence can apply to cases where two or more people are responsible for an accident.  It means you could still make a claim if you were partially at fault for a crash. But any compensation you receive will be reduced.

For example, you or a loved one may suffer injuries in a car accident. You were partially to blame for turning left across traffic when a car was approaching. But the other car was speeding and ran a red light.

If you file a personal injury lawsuit in Orange County, a percentage of the blame will be attributed to you. You may be found to be 10% at fault. In this case, according to comparative negligence laws, your compensation award would be reduced by 10%.

If you are unsure if you were partially to blame for the accident, contact our Orange County personal injury lawyer for a free, comprehensive review, and we can determine if you played a role in causing the accident.

Orange County Personal Injury FAQs

How much will I receive in an injury settlement in Orange County?

A fixed amount of compensation does not apply to every injury case. It will depend on the specifics of your circumstances and your losses. Whether your case settles out of court or goes to trial may also impact you.

A typical settlement can be anywhere from a few thousand to seven or eight figures. The severity of injuries, loss of life, time off work, and many other factors determine the value of your claim.

Consult an Orange County personal injury lawyer for guidance specific to your lawsuit.

When should I hire an accident lawyer?

According to California law, most accident lawsuits must be filed within two years of an accident. We recommend contacting an Orange County injury litigator as soon as possible.

This can be essential in preserving evidence and building the most robust case. Your Orange County accident lawyer will help guide you through every step of the process.

What are the benefits of hiring an accident attorney?

Hiring an accident lawyer in Orange County can be essential to winning your case. Working with an experienced lawyer will significantly improve your chances of success and maximize the compensation you could receive.

Do not leave anything to chance or surrender the upper hand to the insurance negotiators. Work with an expert attorney who will fight and win for you.

Are injury settlements tax-deductible?

This is both a yes and no answer. Many settlements will not be taxed, especially if the compensation will go towards an accident victim’s medical expenses, mental anguish, pain, and suffering. There are exceptions to this rule, though. The compensation received for personal physical injuries is excludable from taxable income for income tax purposes.

IRS Code Section 104(a)(2): We may collect some types of compensation, such as bystander negligent infliction of emotional distress, which might not be excludable. To ensure that the monetary amount you received is non-taxable, seek legal advice.

Bisnar Chase Review - Natalie

I’m so impressed with this law firm. I lost my mother because of a seat defect when she was rear-ended in an auto accident and Bisnar Chase stepped up and took our case. The staff is wonderful and Brian Chase took his time explaining everything via phone with me. I’m honored to have the best of the best working on our family’s behalf, trying to get justice for my Mom, because of a negligent car company still manufacturing faulty seats. I look forward to working with this firm and am hopeful for a positive outcome. Thank you so much, Brian Chase. I know you will work your hardest on this case. God Bless you.

Bisnar Chase Google Review

Great people in this office, everyone was really helpful explaining everything. I was referred by my aunt for my car accident in October and the case went pretty fast. No problems and very professional. I was kept in the loop thru the whole process and was able to get a better settlement than my insurance company said I would. I can’t really compare them to other law firms because it was the first time I had to use an attorney, but my bad experience with the car accident was handled as well as I could have hoped.

Bisnar Chase Google Review

I had an attorney for my truck accident who wanted almost 60% of what my case was worth. Worse than that, he was willing to settle for $5,000.00 with the insurance company even though I was still treating for whiplash and back pain. I contacted Bisnar Chase Personal Injury Attorneys because a friend recommended them. My case was handled exceptionally well! I was being kept notified throughout the whole process and only when I was comfortable with the settlement figure, did my attorney Gavin Long, accept it. I felt like we were working together and I felt listened to. I would refer Bisnar Chase to anyone who wants quality over quantity!
