Do not give too much information about yourself

You only want to give basic information about yourself, such as your name, home address, and cellphone number. You do not need to get into the specifics of your injuries and the circumstances of an accident without speaking to an injury attorney.

Do not give in to the pressure to settle

Adjusters usually try to settle a claim by the first call. This is due to the adjuster wanting to close the case and move on to the next. Insurance adjusters will also want you to settle for less than you deserve. You do not need to agree to anything at this point.

Say no to the call being recorded

If a call is recorded, it can be used as evidence throughout the claim, even if you misunderstood a question or said something you did not mean. You are within your rights to refuse a call recording and should do so.

Questions insurance adjusters try to avoid answering

  • How much can I collect in my injury claim? They will try to avoid this at all costs.
  • Do you have the authority to settle my claim? They usually have a small limit, and anything over that has to go to a supervisor, so they’ll try to keep your claim within their limits.
  • If I seek treatment, will you settle my case faster? The insurance adjuster doesn’t want you to have ongoing treatment and will not tell you how to add more value to your claim. They will not assist you in potentially adding more value.
  • And they will never advise that you may need a lawyer to maximize your claim.

Mutual Fault in Traffic Accidents (Comparative Negligence)

Comparative negligence is the concept that both negligent parties can share responsibility for each other’s damages in certain situations. 

In most states, comparative negligence means that a driver who crashes into another vehicle can be held liable for any damage caused to that vehicle, even if the driver was at fault for the accident.

There are two types of comparative negligence: absolute and relative. In cases where an injured party is found at fault, absolute comparative negligence refers to the degree of fault.

For instance, even if your policy covered the damage, you could still recover from your neighbor’s car insurance carrier if you had a collision with their vehicle.

In another example, if you are involved in an accident while driving 75 mph on the highway and cause $10,000 of damage to another driver’s car, your own policy will not cover those damages. 

However, in a relative case, both drivers would only be liable for their proportional share of the total damages because both drivers were at fault for some role in causing the accident.

Suppose you are found at fault for an injury or property damage incident. In that case, you may be able to hold someone else liable for those damages under comparative negligence. 

In most cases, no one will be considered 100% at fault for an accident based on their actions alone. Comparative negligence only refers to what percentage of fault you hold compared.
