Federal Trucking Regulations and How Violations Affect Your Orange County Case

When a big rig is involved in a crash on the 5, the 405, or any other Orange County freeway, the rules that govern commercial trucks matter a lot more than most people realize. These are federal rules set by the Federal Motor Carrier Safety Administration—usually just called the FMCSA. They apply to almost every tractor-trailer and commercial truck operating across state lines, and California closely follows them.

These regulations exist because an 80,000-pound truck is fundamentally different from a regular car. The rules limit how long a driver can stay behind the wheel, require electronic tracking of those hours, set maintenance standards, and cover everything from cargo securement to drug testing. When a trucking company or driver breaks them, it often becomes strong evidence that someone was negligent.

Hours of Service Rules

Fatigue is one of the biggest factors in serious truck crashes. The Hours of Service rules try to keep drivers from pushing too far. For property-carrying trucks (the ones hauling freight), the basic limits look like this:

A driver needs 10 consecutive hours off duty before starting a new shift. Once that shift begins, they can drive up to 11 hours, and all of that driving must fall within a 14-hour window that starts the moment they come on duty.

Breaks for loading, fueling, or sitting in traffic don’t pause that 14-hour clock. After eight cumulative hours of driving, they also need a continuous 30-minute break.

There’s also a weekly cap—60 hours on duty in seven days or 70 hours in eight days, depending on how the company operates. Drivers can reset that weekly clock with 34 consecutive hours off.

These limits sound straightforward on paper. In real life, companies sometimes pressure drivers to meet tight delivery schedules, leading them to stretch or falsify logs. When that happens, and a crash occurs, the electronic records often reveal the truth.

Electronic Logging Devices

Since 2017, most commercial drivers have been required to use an electronic logging device, or ELD. These devices automatically record driving time, engine hours, location, and duty status. They’re supposed to replace the old paper logbooks that were easy to fudge.

The ELD has to be on the FMCSA’s registered list. Using a device that has been delisted is treated the same as having no log at all. Drivers and carriers must also retain the data for 6 months and produce it upon request. If the device malfunctions, there’s an eight-day window to fix or replace it, and the driver has to switch to paper logs in the meantime.

In a lot of the cases we handle, the ELD data is one of the first things we request. It can show whether the driver was over their hours when the crash happened, whether the company was pressuring them to keep going, or whether records were edited after the fact.

Evidence Preservation and Investigation After a Truck Accident

One of the hardest parts of a commercial truck case is that much of the most important evidence is held by the trucking company, and some of it starts disappearing quickly. Unlike a regular car crash, where the main evidence is often the vehicles themselves and the police report, truck cases turn on electronic records, driver files, and company documents that the carrier controls. Acting quickly makes a real difference.

The Role of a Spoliation (Preservation) Letter

A spoliation letter is a formal written demand sent to the trucking company, its insurer, and sometimes other parties (maintenance providers, brokers, or the cargo shipper). It informs them that litigation is reasonably anticipated and that specific evidence must be preserved. Once they receive it, destroying or altering that evidence can lead to court sanctions, including an instruction to the jury that they may assume the missing evidence would have hurt the company’s case.
