Hit-and-Run Accidents and Lawsuits

A hit-and-run crash is when a driver is involved in a collision with another vehicle, pedestrian, or cyclist and leaves the scene without stopping to check on the victim or exchange information.

Most people think there is no legal recourse in a hit-and-run when the suspect has fled the scene. But you may have options, depending on the circumstances of the crash.

  • If the police catch the driver, you can file a claim against their insurance as with any other car accident. If they don’t have insurance, your options might be limited.
  • If the driver is not caught, you might be able to claim against your own insurance policy, depending on the terms of the policy.
