Subaru Recalling Vehicles that Can Start on their Own: Brian Chase Weighs In

Subaru has announced an auto defect recall for about 50,000 vehicles in the United States and Canada because they could take off on their own without warning. According to a Detroit News report, the remote engine starter in these vehicles could malfunction and start them suddenly and inadvertently.

The Subaru recall covers several vehicle models including the 2012-13 Impreza, 2010-13 Legacy, 2010-13 Outback and 2013 XV Crosstrek, the report states.

According to the article the vehicles could pose a danger if parked in an enclosed garage because of the potential buildup of carbon monoxide, which could result in asphyxiation. The engine in these vehicles may start and run for 15 minutes and the engine may continue to start and stop until the battery in the key fob dies or the vehicle runs out of gas, the report states.

By the end of April Subaru dealers will replace the key fobs at no cost to consumers, according to the article. Subaru started an investigation into the matter after noticing an increase in warranty claims in July. This occurred soon after a supplier had made a change to improve the key fob in 2011, the article states.

"This is a dangerous auto defect that could result in serious injury or death, said Brian Chase, auto recall expert and partner at Bisnar Chase personal injury law firm.

"If you own one of these recalled vehicles, it is important that you take your vehicle to a dealer right away and get it inspected. In these cases, it is never worth it to take a chance."

"Anyone who has been injured in an incident involving a defective vehicle or faulty auto part has legal rights", Chase said.

"Vehicle manufacturers are responsible for the product they put on the market. Injured victims may be able to seek compensation for the injuries and damages they may have suffered as a result of the defective vehicle."

Client Reviews of Bisnar Chase

“I have used Bisnar and Chase twice now, both for car accidents. Each time I received a fair settlement and honestly received more than I expected. The entire team of Bisnar and Chase were professional, courteous and friendly. The paralegals there are top notch! I cannot express enough how much I appreciated the constant communication from them and how they explained things I didn't understand in such a way that I could.
Will I ever use them again? I only hope not to get into another car accident ever so that I don't have to, but I will definitely use them if I do (knock on wood I don't). I highly recommend Bisnar and Chase if you are considering hiring a lawyer for an automobile accident.”

“We received an email from A.G. Edwards stating they have received the settlement check from Nissan. Once again, I cannot begin to articulate our gratitude to the Bisnar Chase staff - we are so very thankful for all you have done for Josh. As parents, Charlotte and I can rest in peace, when that day comes, knowing that Josh's needs have been taken care of, and his financial future is in good hands with sound financial planners at A.G. Edwards. On December 17, 2003 we received a call from the paramedics stating that Josh and Lisa had been in a severe accident, and we needed to meet them at the emergency room. I remember telling God that I can deal with missing limbs because they can be replaced, but please do not take him from us. A month later we met with members of your staff for the first time, Josh had a traumatic brain injury and his future was looking pretty bleak; we had no idea where he would be eighteen months later. All we could think of at the time was that our son's future, his goals, and dreams had been taken from him so abruptly. As time passed, Josh continued to improve and he began his journey of recovery. Many have been involved in this process, and you and your staff have been an integral part of Josh's recovery, and we will be forever grateful. God has brought so many people into our lives, and we are so very blessed. Numerous emails were sent to Personal Injury Attorney's. John...you were on a ski trip at Big Bear with your family, and you were the only Personal Injury Attorney to respond - I believe this was divine intervention. Josh has a professor from Mt. San Jacinto College who has taken him "under his wing," and is showing him other career possibilities. John, the future looks good for Josh - thank you!”
