  • How can you prove the circumstances of the incident? Taking photographs of where you fell can is often a good way to do it. Try to get images of the spill, lack of warning signs and your injuries, if they are apparent. Photograph the ground if there are cracks or an uneven surface.

File an Injury Report

It is important that you file a report with the building manager or property owner. Places of business should have a procedure to file an injury report. Do not go into details about how hurt you are or exactly what happened. Just inform the property manager of when and where the accident happened and that you are going to seek medical attention. Ask for a copy of that report and make sure you get it before leaving.

Seek Medical Attention

There are a number of reasons why seeing a doctor right away is a good idea. First, obtaining immediate care will increase your chances of having a complete and speedy recovery. Second, your medical records help create documentation that will prove when you were injured, the types of injuries you suffered and the treatment you received. Third, failure to see a doctor may be interpreted by the defense to mean that you were not really injured as a result of the fall. The defense may also claim that your injuries worsened as a result of your failure to see a doctor and seek prompt medical attention.
