By Brian Chase on October 17, 2016 - No comments

Deborah Gresham, 44, was killed in a bicycle accident in Stanton after a vehicle struck her the night of October 14, 2016. According to a news report in The Orange County Register, the fatal accident occurred on Cerritos Avenue east of Knott Avenue. Gresham died at the scene. The driver of the vehicle, described only as an adult man, was arrested on suspicion of vehicular manslaughter. However, officials have not said if alcohol or drugs were involved.

Our heartfelt condolences go out to those who knew and loved Gresham. Apparently, she was well-known for having created a popular online fan page for the zombie TV show “Walking Dead” called “Zombie Killers two” on Facebook which attracted more than 20,000 fans of the show.

Bicycle Accident Statistics

One person was killed and 13 others were injured as a result of bicycle accidents in the city of Stanton, according to California Highway Patrol’s 2013 Statewide Integrated Traffic Records System (SWITRS). In Orange County as a whole, nine fatalities and 1,309 injuries were reported due to bicycle accidents during the same year.

What Caused This Fatal Crash?

Based on this news report, the driver in this case was arrested by police on suspicion of vehicular manslaughter. But there are still many unanswered questions here. Was the driver under the influence of alcohol and/or drugs? Did he strike the bicyclist while driving distracted or while inattentive? Did the driver violate the rules of the road such as running a red light, failing to yield to the bicyclist or driving at an excessive rate of speed? Did the driver intrude into the shoulder or bike lane causing this fatal crash? These are just some of the questions law enforcement officials are likely asking during the course of this investigation.

Fault and Liability

In addition to facing criminal charges and penalties, negligent drivers can also be held financially responsible for the damages and losses they cause. Families of deceased accident victims in such cases can file what is known as a wrongful death lawsuit seeking compensation for damages such as medical expenses, funeral costs, lost future income, pain and suffering and loss of love and companionship. Families in such cases would also be well advised to contact an experienced Orange County bicycle accident lawyer who will stay abreast of the official investigation and help ensure that their legal rights and best interests are protected.
