A product liability lawsuit filed against Procter and Gamble claims that the company’s Old Spice deodorant causes severe chemical burns and rashes. According to a Fox Los Angeles news report, the lawsuit claims to seek class-action status and more than $5 million in damages. The complaint names 13 Old Spice products including Old Spice Lionpride and Arctic Force High Endurance deodorants saying that these products affected “hundreds, if not thousands of consumers.”
Chemical Burns and Rashes
A number of people have also posted photos to Facebook and online on Consumer Affairs’ website showing what they describe as painful, severe burns and rashes they have suffered after using Old Spice products. One consumer said he used Old Spice pure sport and after a couple of days his underarms were raw. It burned so badly, he said, he had to hold ice packs under his arms for a couple of days.
Another complaint reads that the product took the skin right off a man’s armpits and made his skin blister and bleed. A P&G spokesman said people were simply describing actual skin reactions to the deodorant. They maintain that Old Spice deodorants are 100 percent safe to use and say the rashes and reactions affect only 0.01 percent of consumers.
Protecting Consumers’ Rights
A class action is a type of lawsuit where one of the parties is a group of people who are represented collectively by a member of that group. We often see class action lawsuits brought in defective product cases, especially those where it is not feasible for one party to take on a large corporation by himself or herself. Class action lawsuits help consumers who feel cheated by a product to get the justice they seek and to hold the manufacturer of the defective product accountable.
A class action lawsuit may not be the answer for everyone who has been harmed or injured by a dangerous or defective product. If you have suffered serious or life-changing injuries that have caused you to be hospitalized, require surgery or lose your livelihood, you may need to file a personal injury lawsuit to get the compensation you need and rightfully deserve.
However, if your injuries were not severe, but you would still like to hold the manufacturer accountable and require them warn consumers about potential harm that could come from using the product, a class action may be an option.
