A boy suffered injuries in a bicycle accident in a south Las Vegas neighborhood after officials say a suspected DUI driver struck him.
According to a news report in the Las Vegas Review-Journal, Ashley Davis, 28, was booked on one felony count of DUI, which listed this as her third offense. According to court records, her earlier offenses were two misdemeanor counts of driving with a suspended license and no registration, the Review-Journal reports.
Ongoing Bicycle Accident Collision Investigation
Police said the crash occurred in a neighborhood near Cactus Avenue. Officials said the boy was transported to an area hospital with “moderate” injuries. Davis identified herself as a food delivery contractor and told police she was driving in a neighborhood when the boy pedaled out of a driveway into her car’s path. Court records show Davis pleaded guilty to misdemeanor DUI following a 2015 arrest. The investigation into this incident is ongoing.
We are relieved to note that the boy did not suffer critical or life-threatening injuries in the bicycle accident. We wish him the very best for a speedy and complete recovery.
Liability of Food Delivery Companies
We’ve seen the rise of food delivery companies and food delivery drivers with the COVID-19 pandemic. However, it has become a convenience for many to just order delivery from their smartphones or tablets. Grocery deliveries are also becoming more popular, putting more delivery trucks and vehicles than ever before on our roadways. The question then arises: Who is liable for accidents caused by delivery drivers?
If the delivery driver is on the job at the time of the incident, in addition to the driver, the establishment they are working for may also be held liable for the incident. Food delivery companies often try to shirk responsibility for these incidents by saying these drivers are not employees but independent contractors.
But these businesses have a responsibility to check drivers’ criminal backgrounds and prior driving records before contracting them for delivery services. These cases can become complex, particularly in cases where victims are injured and facing medical bills, lost income, and other expenses.
If you have been injured in a bicycle accident, or any other type of accident involving a food delivery driver, an experienced Las Vegas personal injury lawyer can help you better understand your legal rights and options. You may still be able to recover compensation for your significant losses.
