Aden Uriostegui was fatally injured in a pedestrian accident in Orange after officials say he was struck by a driver who may have been under the influence and may have run a red light. According to a KTLA news report, Orange police said Sitani Pinomi, 39, was driving with a suspended license at the time of the crash and has had a DUI conviction in the past.
The fatal pedestrian accident occurred the night of May 19 when Pinomi, who was driving a pickup truck, struck Uriostegui, who was walking in a marked crosswalk at the intersection of Tustin Street and Heim Avenue. Family members told KTLA that the 19-year-old was walking home from his job at Starbucks. He had recently graduated from high school, they said. Officials said Uriostegui was in the crosswalk, crossing legally, when he was struck by the F-250 pickup truck.
A witness told authorities the truck was going south along Tustin Street and failed to stop for the red light when it reached the intersection. Uriostegui was pronounced dead at the scene. Pinomi remained at the scene and was taken into custody. Anyone with more information is asked to contact Orange police at 714-744-7342.
We offer our deepest condolences to the family members and friends of Adan Uriostegui for their tragic and heartbreaking loss. Please keep them in your thoughts and prayers.
Laws and Liability Issues
Based on this news report, it appears that the driver, Pinomi, may not only have been operating the pickup truck under the influence, but also ran a red light at the intersection and failed to yield the right of way to the pedestrian was crossing legally in a marked crosswalk. If that is accurate, the driver has violated a number of California laws. It is illegal to operate a vehicle while under the influence of alcohol and/or drugs. Motorists are also required to stop for the red light and yield to pedestrians who are walking in marked or unmarked crosswalks.
In such cases, in addition to facing criminal charges and penalties, DUI drivers can also be held financially responsible for the injuries, damages and losses caused. Victims’ families may be able to file a wrongful death lawsuit seeking compensation for losses including medical expenses, funeral costs, lost future income, pain and suffering and loss of love, care and companionship. An experienced Orange County DUI victims’ lawyer will be able to provide more information to victims and their families about pursuing their legal rights.
