Bisnar | Chase Weighs in on Lawsuit Filed by Veterans against Railroad Company after Deadly Texas Crash

California wrongful death lawyer comments on a lawsuit (Case number CV-49117) filed by two veterans and their spouses against the railroad company whose train hit a truck carrying veterans during a parade in Texas.

According to a Nov. 28 news report in Yahoo! news, four veterans were killed and 16 more people were injured in the Nov. 15 collision.

According to a Nov. 28 Yahoo! news report, the veterans were participating in a parade organized in honor of wounded veterans. The truck carrying the parade participants was crossing the tracks when the crash happened, the article states.

Other veterans are expected to join this lawsuit, which the report says, was filed because "steps needed to be taken quickly to preserve evidence." The lawsuit (Case number CV-49117), which was filed in the 444th District Court in Midland County, Texas, alleges negligence and recklessness on the part of Union Pacific Railroad Inc. and Smith Industries, Inc. the company that owned the truck.

The court documents state that the veterans are not asking for a specific amount in damages because their desire is to prevent these types of accidents from happening again. The wrongful death lawsuit alleges that the railroad company was negligent in 28 ways including failing to provide reasonable and timely audible and visual warning of the oncoming train and failure to provide a safe railroad crossing. The wrongful death lawsuit also alleges that the truck driver failed to exercise due care and caution.

"The warning lights and bells should be in good working order so that vehicles that are crossing the tracks receive adequate warning.

Drivers who are crossing railroad tracks should also be watching out for approaching trains." Victims of railroad accidents and families of deceased victims would be well advised to protect their rights. "The sooner you take action, the better chance there is of preserving evidence that is crucial to the case. With delays, a lot of this evidence could be lost, misplaced or destroyed."
