On Friday I was driving my bmw at 40 mph, gas pedal got stuck all the way down to the floor. The car accelerated a lot… (gas pedal is still jammed into place without any outside interference). I panicked… I saw death flash before my eyes.. I some how put the car in neutral while it revved at 7000 rpm, then stopped it slowly as i tried to turn the car off and it wouldn’t turn off for a couple minutes… I repeatedly pushed the start/stop button then held it to turn off the car while it was revving at 7k. I parked on the shoulder of the city road, out of the way of any cars and put the e-flashers on.Then got out to try to un-jam the pedal… A guy stops behind me and tries to help me out because he saw my car accelerate and rev after i stopped it… I Opened the driver door to pull out the gas pedal, but it wouldn’t budge an inch. With the help of that person that stopped, we looked under and back around the driver door to try to figure out what went wrong. After 10 minutes of inspecting the car, we came into the conclusion that it needs a tow truck. We stepped onto the sidewalk for a minute, all of a sudden a car crashes into the driver side ( the area i was standing in a minute before) of my car at over 40 mph. The driver was drunk, I have her on video walking. It could’ve been me standing there, I would’ve died. I was shaking for hours afterwards… Couldn’t sleep that night. Still not doing well. I almost died twice, once as the car accelerated because of BMW’s jammed pedal. The second time because a drunk driver hit my car that was a direct result if the gas pedal malfunctioning causing me to stop the car in a red non-parking zone. Police showed up and documented everything including picture. The driver of the other car was arrested. I towed my car to the BMW dealer, we then had me move it to their local body shop. I asked the dealer to inspect the gas pedal before moving the car, they said call BMW corporate and ask them to inspect it. The car sits at a local body shop in Torrance. I want to further document the pedal. Should I call BMW monday? The car is a 2008 BMW 135i with a manual transmission and 47k miles (out of warranty) I want to go after BMW for making a defective safety essential component, causing a drunk driver to crash into my car and almost killing me. Do I have a case?

Hi folks – have a reverse dog bite case. My dog snapped at a child that was chasing my dog around the park (no marks (scratches or red marks) on childs face up to 30 min after incident). Gave them my cell number -Mother texted me they were going to sue. She brought the kid to the dr. – doctor ” cleansed” the area. Per animal control, there was a very minor puncture wound – could have been caused by a nail. THERE WERE NO MARKS ON THAT KIDS FACE – this I will swear to. I had just come from a charity function – still had a lot of jewelry on – my dog doesn’t look cheap – had a bad feeling they were going to milk this for all it’s worth – which I’m sure they will. They’re already laying the groundwork and texted me they were looking for an attorney. Would you be interested in this case? and what’s the most they could sue for?

Hi, I already have a lawyer, but I was reading that your firm is fighting the $250,000 cap in medical malpractice lawsuits. Good for you! I have been the full time care giver for my disabled sister for the last 9 years and intended to spend the rest of her/my life doing that. She died in March at Providence St. Joseph Hosptal, the same place actor John Ritter died. She went 15 hours with no pain medication and no emergency surgery. Her autopsy proved she had a strangulated bowel. It is very likely that if they had operated immediately, she’d still be alive. If I can help get rid of this awful cap, I’d like to. The lawyer I’ve contacted said they probably won’t pursue the case if all we can get is the $250k. What do I do then? I’m stuck.

I was walking around Newport Beach last Sunday afternoon. There are squares of sidewalk missing around the trees. The dirt in there is lower than the sidewalk. I stepped on the edge of one of these and fell down. My ankle was sprained. I had to go to Cedar’s Sinai ER in LA that night. I got a parking ticket in Newport Beach for $58 because I couldn’t get back to my car quickly. I also have out-of-pocket medical expenses that will not be covered by my health insurance. I also had to cancel a business trip to Singapore that would have started yesterday evening. I lost $100 cancellation fee, flight insurance fee, and potential business income that would be difficult to quantify. Is there a case here?

our neighbors 2 pit bulls broke through our fence and killed our 10 week old papered lab. We approaced them and asked for vet bill to have our dog creamated, money to pay for another dog and ot fix the fence where their dogs broke through. Their response was they know their dogs are vicious and our dog should not have been in her own backyard.
