Halloween Highway Horrors
Did you know Halloween night is one of the most dangerous nights when it comes to highway fatalities?

In 2008, according to the National Highway Traffic Safety Administration (NHTSA), 58 percent of all highway fatalities across the nation on Halloween night (6 p.m. Oct. 31 to 5:59 a.m. Nov. 1) involved a driver or a motorcycle rider with a Blood Alcohol Concentration (BAC) of .08 or higher, which is illegal in every state.

Turns out, the scariest part of Halloween isn't the spooky costumes and scary pranks. It's the fact that too often impaired drivers don't plan ahead and end-up making the roads scarier than a horror show.

When Halloween parties and social gatherings take place, incidents of impaired driving often increase. But driving impaired, or riding with someone who is impaired, is simply not worth the risk. The consequences are serious. Not only do you risk your life and the lives of others, but also the trauma and financial cost incurred from a crash or arrest for driving while impaired can be significant. Violators face jail time, the loss or suspension of their driver license, increased insurance rates and dozens of other fees.

While the number of impaired driving fatalities has decreased slightly in the recent years, there is still much to be done. According to NHTSA, about three in every ten Americans will be involved in an impaired driving crash at some point in their lives. High Visibility Enforcement efforts, such as sobriety checkpoints, have proven effective in deterring and removing impaired drivers from roads and highways. These activities enable law enforcement officials to evaluate drivers for signs of alcohol or drug impairment that lead to the arrest of violators.

While these efforts are applauded, we must all take a personal responsibility to put a stop to impaired driving on our roadways. Following are some basic steps you can take to keep yourself and your loved ones safe this Halloween:

  1. Plan a safe way home before the festivities begin.
  2. Before drinking, designate a sober driver.
  3. If you're impaired, use a taxi, call a sober friend or family member, or use public transportation.
  4. Use your community's Sober Rides program.
  5. If you happen to see a drunk driver on the road, don't hesitate to contact California Highway Patrol by dialing 911.
  6. Friends Don't Let Friends Drive Drunk. If you know someone who is about to drive or ride while impaired, take their keys and help them make other arrangements to get to where they are going safely.
No costume is clever enough to hide someone who has had too many drinks and shouldn't be behind the wheel.

Student viral video submissions are now being taken as part of a scholarship contest promoting safe driving habits among young adults, the most at-risk group for car accident deaths.

The Viral Video Scholarship Contest is designed to lower the number of car accidents by getting America's youth creatively involved in producing viral videos that promote safer driving habits among high school and college students across the US.

The contest, which offers $25,000 in scholarships toward college tuition at recognized academic institutions, comes at a critical time -- in a tough economy -- when parents and students find themselves struggling to pay escalating tuition costs.

Following are alarming statistics from NHTSA that prompted Bisnar | Chase Personal Injury Attorneys, LLP to create this contest, which is sponsored nationally by the American Lawyer Academy:
  1. In 2008, 241,873 people were injured in car accidents.
  2. In 2008, 3,401 people were killed in car accidents.
  3. Young people aged 15-24 suffered 801 car accident deaths in 2008, the most of any age group in California.
"This is a very important cause for my wife and me as the parents of three college-age drivers," said our own John Bisnar. "It's important for everyone to understand how critical it is to practice safe driving habits, especially young people who are the most impacted."

Violent Crash Kills Pregnant Woman

This is a tragic lawsuit we are currently representing called the Moreno vs. Deep Water Transport Enterprises, Inc., case that involves a mother of two (who was five months pregnant with her third child), killed in a car crash due to an illegally parked truck. Had the truck not been illegally parked, this probably would have been an inconvenient stop on the side of the freeway rather than resulting in the death of a mother and an unborn child.

According to court documents, a paid employee of Deep Water Transport Enterprises, Inc. was driving a tractor trailer truck eastbound on the 10 Freeway in San Bernardino County on August 15, 2007. The driver then illegally parked within the freeway's emergency lane to take a rest inside the truck's sleeper cab at one of the busiest times of the afternoon.

The victim was driving her 1993 Honda Accord eastbound on the 10 Freeway in the same direction of the illegally parked truck when her vehicle experienced a tire blowout. As a result of the blowout, her car swerved abruptly to the right side of the freeway and into the emergency lane where it violently collided with the truck and burst into flames, killing the driver and her unborn baby on impact.

Not only was the driver negligent, careless, reckless and unlawful on the 10 Freeway that day, whose behavior ultimately led to this tragic crash, the trucking company that employed him was negligent as well. We're seeking damages for our clients for wrongful death, loss of consortium, funeral and burial expenses and court costs.

Trial is set for January 25, 2011 in San Bernardino County Superior Court. We'll keep you posted on the outcome.
