Hit-and-Run Law

California Vehicle Code 20001 (a) states: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident."

California motorists are required by law to stop immediately at the scene of the crash contact the authorities when someone has been injured. They must also exchange contact information with the other motorists who are involved in the crash. In the case of a hit-and-run collision, investigators will usually search the crash site for clues, review nearby video surveillance tapes and interview anyone who may have information on the crash to track down the driver who fled the scene.

Pursuing Compensation

If the authorities arrest the hit-and-run driver, the injured victim can file a personal injury claim against the at-fault party to pursue compensation for their losses. Unfortunately, not all Mission Viejo hit-and-run accidents result in an arrest. In cases involving a negligent driver who is not found by the authorities, financial compensation may still be available if the victim has uninsured / underinsured motorist coverage.
