According to news reports, the driver of the truck was found to have been texting while driving as well as being under the influence of Vicodin and Xanax. He has been charged one felony count of vehicular manslaughter by unlawful act with gross negligence while intoxicated and one felony count of driving under the influence causing bodily injury, and will serve up to 10 years in state prison. The prosecutor who settled this case said "the community will never be the same". The behavior of the convicted man has exposed the need for strict laws against texting while driving and harsh penalties for driving under the influence.
