California's
labor laws define overtime as:
- Working over 8 hours in one work day
- Working over 40 hours in one work week
- Working 6 days in one work week
Any employee that works these hours is entitled to overtime pay.
In California, the overtime rate is generally set at one and one
half times the regular pay. Employers are obligated to pay overtime
to any eligible worker by California laws, even if the overtime

There are exceptions to these laws--certain positions that are
considered "exempt" from overtime benefits. This long list of employees
includes executives, managers, and administrative professionals,
to name a few.
The classification of "exempt" positions is established by the
employer in agreement with California labor laws. However, sometimes
these positions are "misclassified," and employees are denied overtime
wages that are owed to them.
