Car Accident Causes Fatality and Serious Injuries

By Personal Injury Lawyer on March 2, 2010 - No comments

Manuel and Maria Mosqueda, 55 and 54 years old respectively, sustained injuries in a car accident after a speeding driver lost control of her car and crashed head-on into their vehicle on the Highway 46 east of San Luis Obispo. According to a report in the San Luis Obispo Tribune, the Mosquedas were traveling west on the highway, in a 2009 Chevy Silverado, the night of February 27, 2010, when an eastbound 2005 Chrysler Sebring struck them head-on. California Highway Patrol officials said 21-year-old Sandy Blake Roberts, a passenger in the Chrysler, died in the crash.

Officials said 20-year-old Nicole C. Deane, who was driving the Sebring, was passing a pickup at a high rate of speed and lost control of the car crossing into opposing traffic lanes. The Silverado was driven by 28-year-old Luis Carlos Mosqueda. Deane also sustained injuries. Karla E. Reyes, 30, another passenger in the Silverado was injured as well.

Tragic Car Crash

My heart goes out to the family and friends of Sandy Blake Roberts for their tragic, untimely and devastating loss. Please keep them in your prayers. I also wish the Mosquedas and Reyes the very best for a speedy and complete recovery from their injuries. It is indeed fortunate that they did not suffer any catastrophic injuries in this crash.

Laws Relating to Speed

Based on this news report, it appears that this accident was caused by Deane's reckless driving. If the details of this news report are accurate, its seems to me that Deane may have been speeding and as a result, lost control of the vehicle. California Vehicle Code Section 22350 (Basic Speed Law) states: "No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic and on surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property."

Claim for Compensation

In this particular case, Roberts' family could seek compensation for his wrongful death from the at-fault driver. The Mosquedas and their passenger can also seek compensation for their injuries, damages and loss from the at-fault driver in this case. In such cases, injured victims and their families would be well-advised to consult with an experienced California personal injury lawyer, who will analyze all facets of the incident and make sure that the negligent parties are held responsible for their actions. The best personal injury law firms will always offer a free and comprehensive consultation to injured victims and their families.
