Wal-Mart Recalls Card Table for Amputation Danger

black  folding card table from Wal-MartWal-Mart is recalling about 73,400 Mainstays five-piece card table and chair sets because the chairs can unexpectedly collapse posing a fall hazard or potential finger injuries. According to an Associated Press news report, the U.S. Consumer Product Safety Commission (CPSC) said that Wal-Mart has received 10 reports of injuries including one finger amputation, three fingertip amputations, sprained or fractured fingers and one report of a sore back.

This recall includes the Mainstays card table sets with a black padded metal folding table and four black padded metal folding chairs. The sets were sold at Wal-Mart stores across the United States and on its website from May 2013 through November 2013 for about $50. Anyone who has these sets is asked to stop using them immediately and return them to Wal-Mart for a full refund. Anyone with questions or concerns is asked to contact Wal-Mart at (800) 925-6278.

Reports of Injuries

Based on this news report, it appears that several people suffered injuries, some severely, as a result of these defective products. Anyone who has suffered an injury as the result of a defective product can file what is known as a product liability claim against the maker of the product.

In such cases, victims or their families will have to prove that the product was defective; that they suffered injuries, damages and losses; and that those injuries or damages were caused by the product’s defectiveness. In addition, plaintiffs will also have to prove that they used the product as intended and as directed. Product manufacturers can also be held liable if they failed to provide proper instructions or warnings to consumers.

In such cases, injured victims can seek compensation for damages including medical expenses, lost wages, cost of hospitalization, rehabilitation, permanent injuries, disabilities, disfigurement, pain and suffering and emotional distress.
