Two men were hospitalized with injuries sustained in a Riverside County car accident, the afternoon of September 5, 2012. According to The Banning-Beaumont Patch, the injury crash occurred near Interstate 10 and State Route 62 in Whitewater and involved three vehicles. California Highway Patrol officials say a Dodge van driven by 62-year-old David Erskine struck a big rig driven by 36-year-old Charles Ashworth of Lodi on the westbound 10 Freeway near the 62.
Officials said the van was traveling a higher rate of speed on the connector road. Erskine failed to see a big rig as he attempted to change lanes to the left. The van struck the rear portion of the trailer and then spun to the left and hit a Chevy pickup driven by 52- year-old Eugene Alvarado. Erskine suffered major injuries and Alvarado sustained moderate injuries. Ashworth was uninjured.
My heart goes out to the injured victims of this crash. I wish them the very best for a speedy and complete recovery. Please keep them in your thoughts and prayers.
Riverside County Car Accidents
According to California Highway Patrol’s 2010 Statewide Integrated Traffic Records System (SWITRS), 85 fatalities and 2,014 injuries occurred involving car accidents in the unincorporated areas of Riverside County. During the same year, traffic collisions countywide caused 190 fatalities and injured 7,632 people.
Lane Change Caused Collision
Based on this news account, it appears that the driver of the van, Erskine, was attempting to make a lane change when the collision occurred. California Vehicle Code Section 21658 (a) states that whenever a roadway has been divided into two or more clearly marked lanes for traffic in one direction the vehicle “shall be driven as nearly as practical entirely within a single lane and shall not be moved from the lane until such movement can be made with reasonable safety.” Officials also say Erskine was traveling at a higher rate of speed.
Fault and Liability
If Erskine is determined to have been at fault here, he could be held liable for the resulting injuries and damages. Injured victims in such cases can seek compensation from the at-fault party for damages such as medical expenses, lost wages and benefits, cost of hospitalization, rehabilitation, permanent injuries, and other related expenses. Car accident victims would be well advised to contact an experienced Riverside personal injury lawyer, who will analyze all aspects of the incident and ensure that the negligent parties are held liable.
