I was Seann's best friend and he was mine. I was the other half of Expiate and his business partner. I don't know how to be more involved in someones life than I was Seann's. One thing I do know is that he would not have wanted to see people misinterpret an event as well as create problems that shouldn't exist. The natural reaction is one of anger when thinking of Seann's loss, however we need to keep in mind that everyone reacts to things differently just like Seann affected each and every one of us differently. Any reaction is normal but Seann would not have wanted to see people argue over him or his name. This is probably making him laugh none the less. The message needs to be awareness here on all levels. Lets learn from this experience rather than fight over it, I know I have managed to find something good during a very horrible time. He meant everything to me!

Virginia,

Thank you for your comment regarding our December 6, 2011 blog article entitled "Man Killed in Malibu Motorcycle Accident". We welcome and invite comments and I appreciate you taking the time to write to correct our article and to express your opinion. I assume Seann was related to you or was close to you. Again I express my condolences.

Thank you for pointing out our reporting error of Seann’s age. I don’t know if that was a typo on our part or that we copied the error from our news sources. Regardless, thank you for pointing it out.

You are certainly entitled to your opinion regarding using Seann’s name, even if I don't agree with it. After all, free speech and freedom of the press are cornerstones of Americans' rights. The appropriate exchanging of differing opinions is healthy in all democratic societies.

Just like newspapers that report news, our blog reports news. In our case, news of accidents. We then go a step further...we provide legal analysis of real world, actual events, based upon the news reports, in order to provide our readers real world insights into their rights and options. We pride ourselves in fairly reporting and analyzing news reports of traffic collisions and other incidents that have caused serious harm or death.

Our blog articles are provided as a public service. Our intention is to assist those who do not have ready access to legal representation to have some idea of their rights and options and thereby level the playing field between the haves and have not's. It is also our intention to provoke thought as to what the cause of an incident may be so that the less common causes are not overlooked in the final analysis.

Keep in mind that our blog was not sent to you. You searched for information on the internet. As a result of your search, you were provided many choices of websites to visit. You choose to visit our website and read our blog article.

Many people who have been in serious accidents as well as their family members and friends, seek information about their accident from internet sources, as apparently you did. It is our intention to provide actual accident information based upon reports from various sources along with additional relevant information such as applicable law, statistics, a cursory analysis and some points for the involved parties and their families to consider that news sources are not equipped to provide. It is our hope that by doing so, fewer people will lose their rights due to lack of information and more wrongdoers will be held appropriately accountable.

We are regularly consulted by accident victims and/or their surviving family members who's rights to recover rightful compensation has been terminated or seriously harmed by the failure to take timely and appropriate action. It is our intention to promote the prevention of these loss of rights by educating our readers as to what was reported to have happened, what their rights may be, what laws may apply, how frequent similar accidents occur, who may be legally at fault, time limits for taking action and so on.

People who have witnessed accidents and then read our blogs have been helpful to police agencies in providing information to assist in the determination of what and who caused various accidents as well as tracking down hit and run drivers that caused an accident and then fled the scene.

In your comment you take issue with using Seann’s name. This is a news report like any newspaper or other online news report. The report has no real value unless it is based on a real event. Using Seann’s name makes it real. Neither you or people interested in what happened to Seann would have found our report if Seann’s name was not used. This is a point I am sure you and I will disagree on.

Our blog has provided a forum for readers to express their well wishes to those involved in accidents, to comment about the accident, to share their feelings and to update all readers on new developments in a case.

We have written thousands of stories like the one you read and have received over a thousand comments. Among the comments are hundreds of "thank you" notes. A couple times a year we receive a strong negative comment like yours, which I personally take to heart. I take into consideration comments like yours verses the comments of people who have been helped. The negative comments are out weighed by the positive comments and “Thank you” notes nearly 50:1.

I am not immune to personal attacks by those who disagree with our positions or our methods. However, the hurt of the personal attacks is outweighed by knowing we are providing a valuable service to people in one of their times of greatest need. I would rather suffer the personal attacks than to see accident victims taken advantage of for lack of knowledge or resources.

Often we hear from family and friends of accident victims whose only information about their family member or friend's accident is our blog, since it was the only information they could find about the accident. They express gratitude that we made the information available and some relief that at least they now have a better idea as to what happened. This is especially true in estranged families. Using the person’s name who was involved in the accident is necessary for these people, otherwise they would not find the information they are looking for.

Thank you for your initial comment and for being open to understanding our intention in providing our blog articles.

Hopefully our blog will contribute to other motorcycle riders being more cautions in their driving.

Please pass on my deepest condolences to Seann’s family and friends.

If you have any suggestions for how we could improve our methods, please share them with me.

Seann Flynn was 29 years old, not 49. Using this tragedy as a reminder to all motorists that accidents can be complex from a legal standpoint and recommende consulting a lawyer is good advice. However, it is DISGUSTING that you used Seann's name, cited specific details of the accident that evoke horrifying images, and speculated about other factors authorities are investigating specific to this accident, e.g, alcohol related. All of this sure makes a stronger emotional connection with your potential clients. You exploited Seann to promote your business. Perhaps YOU owe the family compensation for the use of his name. Your shamless misuse of this accident and inability to get basic facts correct paint a clear picture about you and your firm.
