State Farm's recent report stated that 369 dog bite claims paid over 11 million dollars in 2010 alone. 2009, comparatively, paid out 90.1 million dollars nationwide for dog bite claims. Contact the Dog Bite Lawyers California today if you have a case.

Dog bites in general are a horrific matter, because they often result in the death of young children. 33 dog bites resulted in fatal injuries in 2010, 20 of which were young children. Illinois and Ohio followed California in 2010 with the 2nd and 3rd highest dog bite claims, respectively.

The law is different in each state. In California, the dog owner is responsible for injuries caused by his or her pet regardless of whether the attack occurred on public or private property or irrespective of whether the dog had a history of viciousness.

The Civil Code in California states: "The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness."

Oddly, there are about 4.7 million dog bites in this country every year with many more going unreported. That's about 13,000 every single day! Knowing what to do and who to call after such a personal injury accident is crucial.

There are 3 major steps to take after a dog bite. Following these steps - in this exact order - can make all the difference in your case.

Treat your injuries - safety should always come first and getting medical treatment for injuries that require it should be your first priority. This might seem obvious, but many injuries go untreated and can leave heavy scarring and infection.

Acquire evidence - gathering items such as photographs, geographic details, witness statements, insurance information, and any other relevant information will make a huge difference in your case.

Contact an attorney - dog bite cases are incredibly complicated, so contacting a dog bite attorney in Orange County that knows everything about dog bites is crucial.

If you have any questions about these steps or simply would like to discuss your case and receive a free consultation please give us a call at 1-800-561-4887 any day and any time. We're here to help in this confusing time, and over our 30 years in Orange County, we've seen it all.

Sadly, dog bites happen much more often than you might think. Nearly 13,000 incidents are reported in the United States every single day, with many more going unreported. The reason many of them go unreported is because the victims think they don't have a case.

The fact of the matter is that if you required medical attention after a dog bite, you most likely have a case. If there's a guilty party (dog owner) then you have a case. If you can prove that the defendant owned the dog, the dog bit you while you were lawfully on the premises, and that the bite directly caused your injuries, you have a solid case.

Steps to Take After a Dog Bite

Following these steps can make all the difference in your potential dog bite case in Orange County:

Treat your injuries - safety should always come first and you should do nothing else before you address your injuries

Collect evidence - take photographs, note witness testimonies, and write down any and all of the dog owner's information such as insurance, contact, and geographic location of the attack

Contact a personal injury attorney - dog bites are often complicated, and you're going to need help

A personal injury attorney like ourselves can give you a free over the phone consultation and a no-win no-fee guarantee - meaning if we don't win your case, you don't pay a dime.

Please give us a call at 1-800-561-4887 if you think you have a case or would simply like some advice in your dog bite case. Knowledge is your ultimate weapon against a negligent dog owner. Don't wait, call us now.

One small dog was killed and two others were attacked in a dog bite incident in Lake Elsinore after two pit bulls went on a frightening rampage. According to a news report in The Press Enterprise, the incident occurred October 31, 2011. Police say the two loose pit bulls, which had a history of similar attacks, bit 48-year-old Anna McDonald's 4-year-old papillon, Sydney. McDonald said she was running with her dog when the pit bulls came out of nowhere and ripped Sydney right in front of her. McDonald told the newspaper: "They weren't dogs. These were some other kind of creature."

Horrific Dog Attack

Immediately after killing the small dog the pit bulls ran over to a nearby park where they attacked two other dogs – a small poodle and terrier. The poodle was almost disemboweled in the brutal attack, while the terrier escaped with puncture wounds. The pit bulls released the terrier only after the other dog's owner hit them with a shovel. Both the pit bulls have been captured by animal control officials, who say they intend to seek a judge's permission to euthanize these clearly dangerous dogs.

First of all, my heart goes out to the two Lake Elsinore residents who were traumatized by these horrific dog attacks. I truly hope the two dogs that were mauled recover from their injuries. As a fellow dog owner I sympathize with Anna McDonald.

History of Attacks

Based on this news report, the pit bulls previously lived with their owner right here in Orange County. It appears that they attacked someone in Orange County at which time the owner said he would take the dogs out of state to prevent them from being euthanized. Officials say the dogs may have been actually "hidden" in Riverside County, by their owner.

It is appalling to me that the dog owner would not only hide these dangerous dogs, but continue to let them run loose in neighborhoods and parks. This takes negligence to a whole new level. It shows a callous disregard for the safety of residents and neighbors. I certainly hope this dog owner faces criminal charges.

Holding Negligent Dog Owners Liable

Irresponsible and negligent dog owners can be held civilly liable under California law. California’s Civil Code Section 3342 states: "The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness."

Victims of dog attacks would be well advised to contact an experienced Riverside personal injury lawyer, who will ensure that their rights are protected and that the negligent dog owners are held accountable. Dog owners whose pets are injured or killed in attacks such as these can seek compensation for vet bills and emotional distress. Individuals who are themselves bitten can seek compensation for their medical bills, lost wages, cost of surgery, rehabilitation, pain and suffering, and emotional distress.

A 31-year-old woman was seriously injured in a dog bite incident after she was attacked by two American bull dogs while walking her own pets. According to a news report in The Press-Enterprise, the vicious dog attack occurred in the 200 block of East O Street in Colton, the morning of October 16, 2011. Officials say the woman was walking her dogs with her 11-year-old son when the two loose dogs charged the woman's pets and began to fight with them before turning on the victim. The woman suffered several bites on her chest and one of her legs. Her son used his skateboard to defend his mother by hitting the dogs. He was not injured. The woman was transported to an area hospital for treatment. The dogs' owners have been cited for several municipal code violations.

My heart goes out to this injured dog attack victim. I wish her the very best for a speedy and full recovery. I commend the young boy for bravely defending his mother against the attacking dogs. He very likely saved his mother from further injury by hitting and driving the dogs away.

Dog Bite Statistics

Nearly 5 million people are bitten by dogs each year in the United States, according to the U.S. Centers for Disease Control and Prevention (CDC). According to Dogsbite.org, a Web site for dog attack victims nationwide, of the 88 fatal dog attacks in the United States in a three-year period between January 1, 2006 and December 31, 2008, 59 percent or 52 incidents involved pit bulls, followed by rottweilers (14 percent), and American bulldog and Husky (5 percent each).

California Dog Bite Law

Based on this news report, the dogs' owners have been cited for violating various laws including the city's leash laws. Under California law, dog owners, in addition to being criminally prosecuted for negligence that causes injury, can be held financially responsible for the victims' injuries and damages.

Claim for Compensation

In this particular case, the injured woman can seek compensation to cover all medical expenses, lost wages, cost of hospitalization, cosmetic surgery, pain and suffering, and emotional distress. Dog bite victims would be well-advised to contact an experienced San Bernardino personal injury lawyer, who will stay abreast of the official investigation and ensure that their legal rights and best interests are protected.
There's no logical way to explain this phenomenon other than that as population grows and homes become more crowded, there's more interaction between people and dogs. It might not seem like it happens very often, but there are about 4.7 million dog bites reported every year with many more going unreported.

There are certain breeds - Pit Bull and Rottweiler - that attack much more frequently than others, but many dog species have been known to attack and bite humans. The worst part of the attacks are the scarring they can leave.

A knife cut leaves a simple cut that can be stitched back together easily, but the ripping and tearing action of a dog bite can pull the skin apart and make it much more difficult to stitch up without leaving a scar. Depending on where the scar is, your dog bite case could be worth hundreds of thousands of dollars.

After a Dog Bite in Huntington Beach

The first thing you need to do is gather up all the evidence you can regarding the attack. Photographs, witness statements, and the dog owner's information are crucial details in a dog bite case.

Us here at Bisnar | Chase have seen just about every type of personal injury case, including several dog bite cases and we know how to close these cases and get our clients financial compensation and peace of mind. Please give us a call at 1-800-561-4887 if you have any questions or would like to discuss your case and receive a free consultation.

Dog owners are mostly responsible, but sometimes even the owners can't control their pets. Approximately 10-20 people die each year from dog attacks, with most of the victims being children. Nationally, around 4.7 million dog bites happen every year - that's almost 13,000 per day! It doesn't seem like a common occurrence, but sadly, it is.

4 Things You Have to Prove

The Defendant owned the dog - fairly obvious, but necessary

The dog bit the plaintiff - the basis of your case

The plaintiff was lawfully on the premises where the attack occurred - to have a solid case

The dog bite caused injuries - without injury, there is no case

Once you're able to prove these four things, you should have a good case. Negligent dog owners should not be allowed to get away with this type of act. Dog owners are responsible for their pets in good times and bad. When man's best friend chooses to act out in aggression, the owner is the one who becomes responsible.

A dog can be a man’s best friend or worst nightmare. In California, people love their dogs. They dress them, take them to dog parks, and bring them along for short car rides to run errands. While these adorable animals may be great companions, we shouldn’t forget about their animal instincts. Dogs do bite and sometimes disfigure or even kill unsuspecting victims.

If you speak to a California dog bite lawyer, you will soon find out that when a dog bites a person the dog’s owner is negligent. In fact, when your dog bites and attacks another person they will usually receive a recovery from the owner’s homeowner insurance or renter’s insurance policy.

California is one of many states referred to as a “statutory strict liability state.” Because California is under this law, there are only two prerequisites for a claim to compensation. 1. The victim was bitten by the defendant’s dog and 2. the defendant owned the dog when the victim was bitten.

Dog Bite Statistics

There were 33 fatal dog attacks in 2010 according to Dogsbite.org. Of these attacks, pit bulls accounted for 67% yet only make up 5% of the dog population in the United States. Rottweiler's accounted for 12 % of fatal dog attacks.

The combination of these two breeds is substantial. California led the United States in the number of total fatal dog attacks in 2010.

Two girls, 12 and 9, were injured in a dog bite incident after a pit bull mix attacked them. According to a news report in The Press-Enterprise, the dog attack occurred in a shopping center along 48th Avenue, near Jackson Street, in Coachella, the night of August 23, 2011. Riverside County Sheriff's deputies were called to scene after the pit bull mix attacked the children who were walking on the south sidewalk of 48th Avenue. The 12-year-old girl sustained a serious leg injury while the other girl suffered relatively minor injuries. Officers tried to control the dog. But when the dog attacked the officers, one of them shot the animal, killing it.

My heart goes out to these young dog bite victims, especially the girl who has suffered serious injuries. I wish them both the very best for a speedy and complete recovery.

Dog Bite Statistics

According to Dogsbite.org, a web site for dog attack victims nationwide, of the 88 fatal dog attacks in the United States in a three-year period between January 1, 2006 and December 31, 2008, 59 percent or 52 incidents involved pit bulls. This dog bite fatality finding is generally consistent with an earlier report released by the U.S. Centers for Disease Control (CDC), which stated that pit bulls and Rottweilers together account for 60 percent of fatal dog attacks, followed by German shepherds.

Dog Bite Law

Based on this news report, it is not clear where the dog came from or who its owner was. Was the dog running without a leash in a public place? If so, where was the dog's owner? California has a "strict liability statute" when it comes to dog attacks. This means that dog owners can be held civilly liable for injuries caused by their pets.

Protecting Victims' Rights

Dog attack victims can seek compensation from the dog owner for medical expenses, lost wages, cost of hospitalization, and even cosmetic surgery in cases where the bite causes severe scarring. Victims or their families would be well-advised to contact an experienced Riverside personal injury lawyer, who will stay on top of the official investigation and make sure that the negligent dog owner is held liable.
