This week the Tennessee Governor signed into law a lawsuit deform bill that places a $1 million cap on non-economic damages such as “pain & suffering” in cases of spinal cord injuries, severe burns and the death of a parent of a minor child.
The stated purpose of the new law is to "...reduce the risk of large jury awards and lessen costly risk throughout the court and insurance systems". It will surely serve its purpose but at what cost and to whom?
What this law does is shift the loss suffered by a severely injured person from the business that caused the loss to the person who suffered it. The driver of a minivan was seriously injured in a Los Angeles car accident, which police report, involved an impaired big rig driver. According to an article in the Los Angeles Daily News, the truck accident occurred on the 101 Freeway near Laurel Canyon Boulevard in Studio City, the morning of February 1, 2011. The truck driver lost control when his vehicle slammed into the center divider and then collided with the minivan. The driver of the minivan was seriously injured, while the driver of the truck suffered relatively minor injuries. Police have arrested the truck driver on suspicion of drunk driving.
My thoughts and prayers are with the injured minivan driver following this Los Angeles truck accident. I wish the injured victim a complete and speedy recovery.

Carrie Jean Biondi, 31, was injured in a car accident after her front tire deflated and led to a crash. According to a news report, the injury car accident occurred on Highway 26 west of Heineman Drive in Calaveras County the afternoon of December 6, 2010. California Highway Patrol officials say the incident occurred when the front tire of Biondi's vehicle started to deflate rapidly. Biondi hit the brakes and spun the vehicle around. The car then went off the road, collided with an embankment and came to a rest. Biondi was transported to a local hospital for treatment of moderate injuries. Read the rest »

Evangelina Niche, 49, was killed in a San Bernardino car accident after a motorist crossed into her lane and struck her vehicle, the Inland Valley Daily Bulletin reports. Niche was reportedly driving west on Bear Valley Road near the border of Hesperia and Victorville the evening of July 21, 2009 when an eastbound motorist crossed into her lane and crashed into Niche's car. Niche was taken to an area hospital where she was pronounced dead. A man and a woman in the other vehicle suffered minor to moderate injuries. San Bernardino Sheriff's officials are investigating the fatal car crash.

A woman was critically injured in a Glendale car-bicycle accident the afternoon of May 2, 2009 after she was hit by a driver suspected to have been driving under the influence of a controlled substance, the Glendale News Press reports. The bicycle accident occurred when Herbert Davis, who was driving his sport utility vehicle westbound on West Los Feliz Road veered off, jumped a curb and struck the bicyclist. The woman suffered broken bones and serious personal injuries, but is expected to survive, Glendale police officials say. Davis apparently struck a telephone pole, sideswiped another vehicle and barreled through five newspaper stands before coming to a stop.
Investigators are still trying to figure out when and where Davis struck the cyclist and also whether she was riding the bike, walking or standing next to it at the time of the car collision. Police have arrested Davis on suspicion of driving under the influence of a controlled substance and took him to the hospital for evaluation.
My heart goes out to the woman who was injured in this horrific DUI car accident. At this point it seems as if this could have been a bicycle accident or a pedestrian accident depending on the victim's actions at the time. I trust that the driver, Davis, who officials say was under the influence of a controlled substance, will be held civilly and criminally responsible for causing this bike-car accident and resulting personal injuries.
