<p>One small dog was killed and two others were attacked in a <a href="http://www.bestattorney.com/dog_bite.html" target="_blank">dog bite</a> incident in Lake Elsinore after two pit bulls went on a frightening rampage. According to a news report in The Press Enterprise, the incident occurred October 31, 2011. Police say the two loose pit bulls, which had a history of similar attacks, bit 48-year-old Anna McDonald's 4-year-old papillon, Sydney. McDonald said she was running with her dog when the pit bulls came out of nowhere and ripped Sydney right in front of her. McDonald told the newspaper: "They weren't dogs. These were some other kind of creature."</p>
<p><span id="more-3604"></span><strong>Horrific Dog Attack</strong></p>
<p>Immediately after killing the small dog the pit bulls ran over to a nearby park where they attacked two other dogs – a small poodle and terrier. The poodle was almost disemboweled in the brutal attack, while the terrier escaped with puncture wounds. The pit bulls released the terrier only after the other dog's owner hit them with a shovel. Both the pit bulls have been captured by animal control officials, who say they intend to seek a judge's permission to euthanize these clearly dangerous dogs.</p>

I truly hope the two dogs that were mauled recover from their injuries. As a fellow dog owner I sympathize with Anna McDonald.</p>
<p><strong>History of Attacks</strong></p>
<p>Based on this news report, the pit bulls previously lived with their owner right here in Orange County. It appears that they attacked someone in Orange County at which time the owner said he would take the dogs out of state to prevent them from being euthanized. Officials say the dogs may have been actually "hidden" in Riverside County, by their owner.</p>
<p>It is appalling to me that the dog owner would not only hide these dangerous dogs, but continue to let them run loose in neighborhoods and parks. This takes negligence to a whole new level. It shows a callous disregard for the safety of residents and neighbors. I certainly hope this dog owner faces criminal charges.</p>

The Insurance Journal reports that State Farm recorded 369 dog bite claims and paid out $11.3 million in California in 2010. <p>A <a href="http://www.bestattorney.com/dog_bite.html" target="_blank">dog bite</a> incident in Bakersfield involving two pit bulls has left Alisha Billington and her family in fear, ABC News reports. Officials say the pit bull attack occurred on April 24, 2011. The Billington family dog, Dallas, was killed by two pit bulls that charged through their fence into their backyard. The dogs also turned and attempted to bite Billington's husband. Since no humans were injured in the incident, the authorities were not able take the dogs into custody. On April 28, 2011, the vicious dogs tore through the fence again. No one was injured that time either. One of the animals was surrendered to animal control after this second incident, but the seemingly vicious dogs continue to remain next door to this family. Billington says she now fears for the safety of her 2-year-old daughter.</p>

<p>A 4-year-old boy sustained major injuries in a <a href="http://www.bestattorney.com/dog_bite.html" target="_blank">dog bite</a> incident in San Bernardino as he was spending time in a relative's house. According to a news report in The Press Enterprise, the boy and his mother were from Michigan visiting family members in San Bernardino. Police say the child was playing in the backyard of a home in the 1500 block of West Windsor Street and had just picked up a toy. That was when the pit bull attacked, unprovoked and without warning. The boy sustained severe bites to the back of his head, buttocks, arms and hands. However, he is expected to survive. The boy's mother and grandmother were also injured as they tried to get the dog off the child. No one has been arrested or charged.<span id="more-1494"></span></p>
<p>My heart goes out to this little boy who has apparently suffered serious <a href="http://www.bestattorney.com/personal_injury.html" target="_blank">personal injuries</a> in this brutal dog attack. I truly hope this child will not be left with permanent scars and pray that he has a complete recovery.</p>
<p><strong>Dog Bite Statistics</strong></p>
<p>During the five-year period between January 1, 2005 and March 8, 2010, 158 fatal dog attacks took place in the United States, according to data released by Dogsbite.org. Pit bulls were responsible for 56 percent of these attacks. This amounts to a pit bull killing an American every 21.5 days. Rottweilers accounted for 15 percent of dog bite fatalities. Together, pit bulls and Rottweilers accounted for 70 percent of all dog attacks. The numbers also show that there were 32 dog bite-related deaths in 2009 – 14 caused by pit bulls and four by Rottweilers. </p>
<p><strong>A Dangerous Breed?</strong></p>
<p>Pit bull advocates often talk about "blame the owner, not the dog." Their argument is that the problem is not with the breed (pit bull), but with the way these dogs are trained by the owners. Just over the last month, we have written about at least half a dozen pit bull attacks in Southern California. A majority involved children, but these dogs don't spare adults either. In each one of these cases, including the most recent one in San Bernardino, the attacks were unprovoked. As a <a href="http://www.bestattorney.com/california-personal-injury-lawyer.html" target="_blank">California personal injury lawyer</a> who represents dog bite victims, I have seen tragic cases where children and adults are physically and emotionally traumatized by these attacks.</p>
<p>It is absurd to say that the media turn a blind eye when other breeds of dogs attack and injure people. How many times have you heard about a Golden Retriever or a Chihuahua mauling a child? Why is it that four times out of five, it's a pit bull that seriously injures or kills someone? Does it always happen because the owner was at fault or didn't care for the dog properly? <p>Hao Yun "Eddie" Lin, a 33-year-old letter carrier, suffered fatal <a href="http://www.bestattorney.com/personal_injury.html" target="_blank">personal injuries</a> the afternoon of May 25, 2010 after he was attacked by a Rottweiler on his Oceanside route, which caused him to fall and hit his head. According to a news report in the North County Times, Lin was found lying on the street with a major head injury that day and taken to a local medical center. He had severe brain swelling from the fall and died from those injuries on June 3. The Rottweiler that attacked Lin was put down at the owner's request, officials said. An investigation is ongoing.<span id="more-1488"></span></p>
<p>I offer my deepest condolences to the family of this postal worker. Lin is survived by his wife, Teri, and three young children. Tragic! His grieving family members and friends will be in my thoughts and prayers.</p>
<p><strong>Postal Workers and Dog Bites</strong></p>
<p>According to the U.S. Postal Service, in 2006, 3,184 letter carriers were <a href="http://www.bestattorney.com/dog_bite.html" target="_blank">dog bite</a> victims in the United States. In the Orange County/Long Beach area, postal employees suffered the most dog bites in 2006 – 96 incidents. This area was followed by Houston with 94 dog bites, Sacramento with 82 and Los Angeles, 77. </p>
<p>Based on this news report, the postal worker, Lin, was not bitten by the Rottweiler. The dog apparently charged him and may have pushed him over causing Lin to hit his head and sustain the fatal head injury. There are still several unanswered questions here. How did the dog attack him? Was the dog unrestrained? Did the dog have a prior history of vicious attacks? </p>
<p><strong>California Dog Bite Law and Liability</strong></p>
<p>California law holds dog owners responsible for attacks and injuries caused, no matter what. The only exception to the "strict liability statute" is if the dog attacks a burglar, trespasser or assailant. California’s Civil Code Section 3342 states: "The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness."</p>
