A 58-year-old worker was fatally injured on the job after an aerial boom he was operating fell off a flatbed truck at a construction lot in Palm City. According to a news report in The San Diego Union-Tribune, the fatal accident occurred the morning of December 6, 2011 on Hollister Street near Palm Avenue in Palm City. Officials say the worker was driving the piece of heavy equipment off a flatbed truck when one of the wheels came off the side of the truck. The man, who was in the basket part of the equipment, which is used to hoist construction workers into the air, hit his head after he was hurled to the ground. The man died at the scene. An investigation is ongoing.

I offer my deepest condolences to the family members and friends of this deceased construction worker. Please keep this grieving family in your thoughts and prayers.

Construction Accident Statistics

According to Cal-OSHA's fatality statistics, 56 people died in construction-related accidents in California in 2009. Of those 11 people died in transportation-related accidents, 30 died as a result of falls and four were fatally injured as a result of contact with objects and equipment.

What Caused This Fatal Accident?

Based on this news report, it is not clear what caused one of the wheels to come off. That event apparently led to the victim's fatal injuries. There are several questions here. Was this accident the result of a defective product? Did the malfunction occur because the equipment was not maintained properly? Was the worker trained to perform the task at hand? Was he given appropriate safety training? Was he being supervised at the time? I trust officials are asking these and other questions in order to determine what occurred here and why.

Compensation for Workers' Families

In such cases, deceased workers' families can receive workers compensation benefits from the employer. In this particular case, if a defective product led to the accident, then, the family can file a wrongful death claim or third-party claim against the manufacturer of the defective product. Similar third party claims can also be filed against a general contractor, sub-contractor, property owner, or other parties (other than the employer) whose negligence may have caused or contributed to the incident. An experienced San Diego personal injury lawyer will better advise victims' families about their legal rights and options.

Eight people suffered injuries in a boating accident after a powerboat exploded in Huntington Harbour, the morning of November 26, 2011. According to a news report in The Orange County Register, the incident occurred on a boat that was headed to Long Beach. Officials say nine people, ranging in age from teens to 50, were on the 26-foot powerboat. The boat was two to three minutes away from the harbor's main public launching ramp when the driver noticed gasoline leaking and told passengers that they should turn back. That was when the engine began sputtering and exploded. The impact from the explosion caused passengers to be thrown into the ocean. Passengers suffered a variety of injuries including broken bones, scrapes and bruises and were transported to area medical centers. Officials are looking into the cause of the explosion.

My heart goes out to the injured victims of this boat explosion. I truly hope none of the victims suffered major or life-threatening injuries. I wish them all the very best for a speedy and complete recovery. Please keep them in your thoughts and prayers.

Boating Accident Statistics

According to the U.S. Coast Guard's 2010 statistics, there were 4,604 recreational boating accidents in the United States that resulted in 672 deaths, 3,153 injuries and $35.5 million in property damage. The most common types of vessels involved in reported accidents were open motorboats (46 percent), personal watercraft (20 percent), and cabin motorboats (14 percent). During the same year, 59 boating accidents were caused by ignition of spilled fuel or vapor, which resulted in one death and 38 injuries.

What Caused the Explosion?

Based on this news report, it appears that a gasoline leak led to the explosion. However, it is not clear why the gasoline leak occurred in the first place. Did this incident involve some type of defective product such as a faulty part? Was the boat properly maintained? Was the powerboat privately owned or did it belong to a recreational boating company? Did the boating company's negligence or failure to fix a problem on the vessel cause this explosion? I trust investigators are looking into these and other issues in order to determine precisely what occurred here and why.

Victims' Claim for Compensation

If the boating company is determined to have been negligent, then, they can be held liable for the victims' injuries. In such cases, injured victims can seek compensation to cover medical expenses, loss of wages, hospitalization, surgery, physical therapy, pain and suffering, and emotional distress. Victims would be well advised to contact an experienced Huntington Beach personal injury lawyer, who will stay abreast of the official investigation and ensure that their legal rights and best interests are protected.

Roberto Magdariaga, 62, died and another man is in critical condition after both suffered injuries on the job at a paint manufacturing plant in Fullerton. According to a news report in The Orange County Register, firefighters responded to Vista Paints in the 2000 block of Orangethorpe Avenue, the afternoon of November 15, 2011. Officials say the men were exposed to chemicals at the plant and were overcome by the fumes. Magdariaga was pronounced dead at a hospital. The second worker, who is 45 years old, is in critical condition. Officials report the chemical that caused the fumes is a paint stripper.

Cal/OSHA has opened an investigation into this fatal industrial accident. The men had been working inside a tank, and were found unconscious by a co-worker who pulled them out with the help of other employees. Vista Paints has apparently been cited several times over the last five years for a variety of violations. In 2008, the company's employees were cited for an accident in Palm Desert.

I offer my deepest condolences to the family members and friends of Roberto Magdariaga for their devastating loss. My thoughts and prayers are also with the critically injured worker. I wish him the very best for a speedy and complete recovery.

What Caused This Tragedy?

Based on this news report, it is unclear as to how or why the fumes were released when the workers were in a confined space. There are several unanswered questions here. Was this accident the result of a defective product? Why were the workers in a tank, a confined space, by themselves without supervision? Were the workers trained adequately to perform these jobs? Were they given safety equipment such as masks before getting into the tank? Did their employer provide adequate safety training? I trust Cal/OSHA officials are looking into these and other issues in order to determine precisely what caused this horrific tragedy.

Compensation for Workers and their Families

Injured workers and families of deceased workers can seek workers compensation benefits from their employers. However, this type of compensation can be woefully inadequate for a family that has lost its primary wage earner, or for a worker who is permanently disabled. In such cases, an experienced Orange County personal injury lawyer can help by determining the existence of a third party claim. These are claims for compensation that are filed against parties other than the employer. Examples of third parties include a contractor, sub-contractor, property owner, or manufacturer of a defective product. The best personal injury law firms will always provide a free consultation and comprehensive case evaluation to injured victims or their families.

According to a news report in The Orange County Register, the incident occurred at 2540 W. Lincoln Avenue. Officials say the men were burned in the explosion while they were replacing an above ground power vault in front of an apartment complex. Two of the workers are contractors with the city of Anaheim, while the third worker is an employee with Anaheim Public Utilities. The men were transported to an area hospital for treatment of their injuries. The condition of the workers or the extent of their injuries is not known at this time.

My heart goes out to the three victims who were injured in this explosion as well as their families. I wish the injured workers the very best for a speedy and complete recovery. Please keep them in your thoughts and prayers.

Workplace Accident Statistics

There were six fatalities in California worksites involving fires and explosions in the year 2009, according to the California Department of Occupational Safety and Health, also known as Cal/OSHA. In 2009, there were a total of 409 fatalities as a result of job-related accidents in California.

What Caused This Explosion?

Based on this news report, it is unclear as to how or why this explosion occurred. There are several unanswered questions here. Was this accident the result of a defective product or equipment malfunction? Were the workers properly trained to do their jobs? Did they receive the necessary safety training? Were they given the necessary safety equipment to carry out this dangerous job? I trust Cal/OSHA investigators are looking into these and other issues in order to determine precisely why this worksite explosion occurred.

Compensation for Injured Workers

In such cases, injured workers can seek workers compensation benefits from their employers. In addition, they may also be able to file a third-party claim against a party other than the employer who may have been responsible for the accident. Examples of third parties include general contractors, sub-contractors, property owners, and manufacturers of defective products. Often, third-party claims can help provide workers and their families much-needed compensation to pay for medical expenses and rehabilitative treatments such as cosmetic surgery or physical therapy.

Injured workers would be well advised to contact an experienced Orange County personal injury lawyer who will stay on top of the official investigation and ensure that their legal rights and best interests are protected.
At least eight people were hospitalized at an Anaheim food processing center after a carbon monoxide leak made them ill, the afternoon of September 28, 2011. According to a news report in The Orange County Register, the incident occurred at L & L Food Inc. in the 300 block of North Euclid Street. Officials say fire crews responded to an industrial park after an investigation by the Occupational Safety and Health Administration (OSHA) officials turned up high readings of carbon monoxide, a poisonous gas that could be fatal. Eight people, all believed to be employees, were transported to an area hospital. Their injuries are not believed to be life-threatening. The source and cause of the leak is still to be determined.

My heart goes out to all those employees who were affected by this incident. I wish them all the very best for a speedy and complete recovery.

Statistics Relating to CO Poisoning

Carbon monoxide is the number one cause of poisoning deaths and serious injuries relating to poisoning in the United States. According to the Journal of the American Medical Association, about 2,100 unintentional deaths in the United States are attributed to carbon monoxide poisoning every year. In addition, approximately 10,000 people are injured each year in the country as a result of carbon monoxide poisoning.

What Caused This Gas Leak?

Carbon monoxide is a colorless, odorless and tasteless gas, which can be produced when burning any fuel such as gasoline, propane, natural gas, oil, wood or coal. The most common symptoms of carbon monoxide poisoning include severe headache, dizziness, mental confusion, nausea, or faintness. These symptoms are often similar to the flu, food poisoning, or other illnesses.

Based on this news report, it is still unclear as to what caused the carbon monoxide leak at this Orange County food processing facility. I trust OSHA investigators are looking into whether negligence on the part of the employer, or violation of federal or state safety standards caused or contributed to this particular incident. It is also not clear if a defective product may have caused this leak.

Compensation Issues

In such cases injured workers can seek compensation for medical and hospital expenses, lost wages, and other related costs through their employer. In addition to workers compensation, workers may also file a third party claim if the incident was the result of negligence on the part of a party other than the employer such as the manufacturer of a defective product. An experienced Orange County personal injury lawyer will better advise injured victims and their families about their legal rights and options.

A worker was hospitalized after suffering injuries on the job from an electric shock he received while working on an air conditioning unit. According to a news report in The Orange County Register, firefighters responded to the scene the morning of September 22, 2011. The man, who was on the roof of a business at 3309 S. Bristol Street in Santa Ana had difficulty breathing after being shocked. The man, who was in his 40s or 50s, was alert and talking to paramedics as they treated him. He was transported to an area trauma center for treatment.

My heart goes out to the injured worker. I'm relieved to hear that he was not critically injured. I wish him the very best for a speedy and complete recovery.

Statistics Involving Electrical Accidents

According to the Center for Construction Research and Training, between the years of 1993 and 2003, 1,715 people were killed in workplace electrical accidents. Electrical workers were involved in 34 percent of all workplace electrocution fatalities. While 58 percent of fatal electrocution accidents involve electrical wiring and equipment, 34 percent involved contact with an overhead power line.

Causes and Compensation Issues

Based on this news report, it appears that the worker was on the roof fixing an air conditioning unit when he suffered the electric shock. There are several questions here. Was this accident the result of a defective product? Was he alone on the roof? Had he been trained properly to fix this appliance? Was he provided with protective equipment to avoid injuries? Was he trained on how to be safe on the job? Did this incident occur due to negligence on the part of the property owner or some other individual or entity?

In such cases, the injured victims will be eligible to receive workers compensation benefits to help pay for medical expenses, hospital costs and loss of wages. Also, victims, depending on the circumstances of the incident, can file third party claims against individuals or entities other than the employer, whose negligence may have caused or contributed to the incident. An experienced Santa Ana personal injury lawyer will be able to better advise workers and their families about their legal rights and options. The best personal injury law firms will always offer a free consultation and comprehensive case evaluation to injured victims and their families.

Tuan Phan, 49, suffered fatal injuries on the job in an industrial accident in Orange County, the afternoon of August 19, 2011. According to a news report in The Orange County Register, the industrial accident occurred at American Apparel in the 12000 block of Pala Drive in Garden Grove. Phan was operating a circular knitting machine when it crushed him. He was transported to a hospital in Anaheim where he died from his injuries. An investigation is ongoing.

I offer my deepest condolences to the family members and friends of Tuan Phan for their tragic and heartbreaking loss. Please keep them in your thoughts and prayers.

What Caused This Tragic Accident?

Based on this news report, it is not quite clear as to how or why this tragic accident occurred. We do not know the circumstances of this accident at this time. There are several unanswered questions here.

How did the worker get crushed by the machine he was operating? Was the worker experienced in performing his task? Had he received adequate job training and safety training? Was he being supervised at the time? Did the machine have protective guards? Was the worker provided with the necessary equipment to keep him safe on the job and to prevent these types of accidents? Was this accident the result of a machine malfunction or a defective product? I trust investigators from the California Department of Occupational Safety and Health (Cal/OSHA) are looking into these and other issues in order to determine precisely what occurred here and why.

Compensation Issues

In such cases, workers families are entitled to workers compensation benefits from the employer. However, these benefits are woefully inadequate when it comes to compensating the family for the loss of a sole breadwinner or primary wage earner. It would in the best interests of family members to look into whether there is a third-party claim. Such claims help families of deceased workers seek additional compensation from a party other than the employer and who may have been responsible for the incident. Examples of third parties include general contractors, sub-contractors, property owners, and manufacturers of defective products.

Victims' families would be well-advised to contact an experienced Orange County personal injury lawyer who will stay abreast of the official investigation and make sure that their legal rights and best interests are protected. In this particular case, the machine in which the worker was trapped must be preserved and examined by an expert for any evidence of lack of maintenance, product defects, or malfunction.

Several workers suffered injuries on the job the afternoon of August 9, 2011 in a Sylmar building after a powerful explosion tore open the roof. News reports identify the two critically injured victims of this explosion as off-duty Los Angeles firefighter Timothy Larson and Tyson Larson. It is not clear if they were related. Officials say the explosion occurred in a 7,400-square-foot facility at 12349 Gladstone Avenue.

Powerful Explosion

Fire officials say the building housed an alternative fuel business that involved the extraction of hydrogen from water. The process apparently involves two pressure vehicles with 20-inch diameters that are 8 feet tall. Investigators are still looking into whether these large vessels were related to the explosion. The explosion was so powerful that it blew a hole through the roof. The two critically injured victims were thrown from the building into an alley. Several others suffered relatively minor injuries. Timothy Larson sustained major injuries to his arms and legs and was undergoing surgery. Tyson Larson's condition is unknown at this time.

My heart goes out to everyone who was injured in this industrial accident, particularly Timothy and Tyson Larson, who were critically injured. I pray for their speedy and complete recovery.

Statistics for Industrial Explosions

According to the California Department of Occupational Safety and Health's (CAL/OSHA) industrial accident statistics for 2005, 14 workers died that year in fires and explosions at their workplace or manufacturing facilities. Totally, 253 deaths relating to industrial accidents were reported in California in the year 2005.

What Caused This Industrial Accident?

There are still several unanswered questions here. Were there workers in this alternative fuel facility trained adequately to perform their jobs? Were they following all the required safety procedures? Did they have knowledge of those safety procedures? Was a dangerous or defective product involved? I trust an investigation by local authorities as well as the CAL/OSHA will provide some answers, although it could take months before we find out precisely what occurred, and why.

Compensation Issues

Injured workers in such cases will be entitled to receive workers compensation benefits to cover some of the medical expenses and lost wages. However, it is important to remember that California workers' compensation benefits are extremely inadequate especially considering the tremendous loss these workers and their families have suffered and may continue to suffer.

Injured victims would be well-advised to contact a reputed Los Angeles personal injury lawyer who has experience in filing "third-party claims." These are claims that are usually filed against someone other than an employer whose negligence may have caused the accident and injuries. Examples of such third parties could include contractors, sub-contractors or the manufacturer of a defective product. A third party claim would be much more valuable to these injured workers than what they will receive from workers compensation. Above all, these injured workers need a skilled and dedicated injury lawyer on their side who will fight hard for their rights and protect their best interests.

A worker sustained serious burn injuries on the job after an overhead line burst at a business near Little Tokyo and doused the victim in the face with an acidic fluid. According to an Associated Press news report, the spill occurred the afternoon of May 26, 2011 at 1205 Wholesale Street, near Alameda Street. Los Angeles Fire Department officials said an overhead line ruptured causing two to five gallons of acidic fluid to spill on the worker. The employee suffered injuries to the face and eyes and was transported to a nearby hospital. The victim's present condition is not known. Officials are looking into what caused the pipe to rupture.

My heart goes out to this injured worker and his family for what they are going through at this time. I wish him or her the very best for a speedy and complete recovery. Please keep this injured victim in your thoughts and prayers.

What Caused This Accident?

This news report leaves many questions unanswered. What kind of work was the employee doing at the time? What caused the overhead line to burst? Was this incident the result of someone else's negligence? Was the pipe faulty or defective? Did this incident involve a defective product? Were all employees at the business trained properly to do their jobs? Did all employees at the location receive appropriate safety training? I trust officials are looking into these and other issues in order to determine precisely how this horrific accident occurred.

Compensation Issues in Work Injury Accidents

In this case, the injured employee will be able to receive workers compensation benefits to cover medical expenses and a portion of lost earnings. However, California workers compensation benefits are woefully inadequate and often do not cover all medical and rehabilitation costs, especially in case of serious injuries where workers have to be off work for a longer period of time. Workers compensation may not cover, for example, plastic surgery costs to repair burn injuries.

In such cases, it would be in the injured worker's best interest to seek the counsel of a reputed Los Angeles personal injury lawyer, who has a successfully handled third party claims. Such claims are usually filed against a party other than the employer and may have caused or contributed to the incident. Examples of third parties include a contractor, sub-contractor or the manufacturer of a defective product. A successful third party claim will provide compensation to the injured worker in addition to workers compensation benefits. The best personal injury law firms will always offer a free consultation and comprehensive case evaluation to injured workers and their families.

Seriously injured in a Los Angeles County on-the-job accident? Want to know if you have a case? Want to know what your case is worth? Want compensation for your injuries? Want justice? Want to make sure the same thing doesn’t happen to someone else?

Denture cream zinc poisoning lawsuits are not going anywhere. In fact, victims' claims have been steadily increasing and it looks as though 2011 will hold countless more lawsuits against Poligrip, Fixodent, and other name brand denture cream manufacturers. Victims who have endured the most serious effects are outraged by what should be an easy fix: properly notifying their customers of their product's potentially life-threatening poisonous contents. Unfortunately, no noticeable effort has been made by these manufacturers to fully educate their consumers, so it comes as no surprise that more consumers are continue to sustain injuries.

Many of those who use this defective product are completely unaware that it contains a potentially life-threatening chemical. Since the Food and Drug Administration do not currently require warning labels in these instances, there is no telling how many people will suffer serious injuries at its hands simply because no one told them it was dangerous. If you or a loved one uses denture cream, and are experiencing one or more of the following side effects, contact your primary care physician immediately.
