Two men sustained personal injuries after they were pinned between two vehicles at a construction site in downtown San Diego. According to a news report in the San Diego Union-Tribune, the accident occurred the afternoon of December 8, 2009 at Market Street and 10th Avenue, where two men were sitting on the tailgate of a truck eating lunch. It was at that time that a car backed up and hit the vehicle parked in front of the truck.
Injury Accident at Construction Site
The impact from the collision pushed the truck into a vehicle parked behind it. Construction workers quickly pushed the two vehicles apart and helped free the two men who were pinned in between. The injured victims, who officials said were 25 and 35 years old, were transported to a local hospital. One person was more seriously injured than the other, San Diego fire officials said.
According to the California Department of Occupational Safety and Health (DOSH), hundreds are injured or killed every year as a result of accidents involving vehicles at construction sites. In this particular case, it appears that these two men were construction workers on a lunch break. In such cases, it is important to look into whether all safety procedures were followed at a construction site in terms of moving vehicles. I trust investigators are also looking into whether it was safe for the men to take a lunch break at that location.
Filing Third Party Claims
In any accident involving a job injury, the worker is likely to receive California workers compensation benefits through his or her employer to cover medical expenses and loss of wages. However, worker's compensation benefits are hardly adequate when it comes to serious injuries that might keep someone out of work for a lengthy period of time. In such cases, injured victims or their families (in cases where a victim is deceased) may file what is known as a "third party claim." Such claims are filed against a party who is not the employer. This could be a contractor, sub-contractor or the manufacturer of a defective product whose negligence caused or contributed to the construction or industrial accident.
