The personal injury law firm of Bisnar | Chase has filed a wrongful death and multiple personal injury lawsuit against Walnut Valley Unified School District, the City of Diamond Bar and the driver of a sport utility vehicle who drove recklessly causing a car accident that killed 3-year-old Michelle Kwon and severely injured her father Soonil Kwon and sister Christine Kwon.
Our attorneys filed this lawsuit in Los Angeles Superior Court on behalf of our clients, who are not only grieving the loss of their youngest child and sibling, but are also dealing with recovering from their own severe personal injuries. My heart goes out to the members of this close-knit family.
The fatal car versus pedestrian accident occurred on November 26, 2008 when Conrad Pantig Maglonzo drove his 1992 Nissan Pathfinder over the curb of Maple Hill Road and onto the sidewalk striking and killing Michelle and seriously injuring Christine and Soonil Kwon. This tragic accident was the result of the school district and the city allowing a dangerous condition to exist outside the school and on the street of Maple Hill. There were parking problems and traffic congestion around the elementary school particularly, before the start of school.
The school's attempt to correct the situation by using traffic cones to block off a driveway, in fact, made it worse. It basically created a dangerous condition where parents hurried to drop off students. On the day of the fatal collision, Maglonzo accelerated driving up the curb in an attempt to cut into a curbside parking spot.
We sincerely hope that this family receives the justice and compensation they rightfully deserve. These lawsuits are, however, not just about financial compensation. In my opinion, if this situation around the school is not remedied, there are likely to be more injuries and God forbid, more fatalities. In my opinion, it would be a travesty to see another family go through what this family has suffered. Our goal is to not only make sure our clients are fairly compensated, but also for this dangerous condition to be rectified.
