Motorcycle Crash Causes Serious Injuries

By Personal Injury Lawyer on July 13, 2010 - No comments

John Madeiros, 46, sustained major injuries in a motorcycle accident in Clearlake on July 8, 2010. According to a news report in the Record-Bee, Madeiros was riding a 1997 Harley Davidson motorcycle on Highway 20 near Orchard Shores Drive when the motorcycle crossed over the center lines and struck a 1975 Ford F-150 pickup truck driven by 39-year-old David Andrade. California Highway Patrol officials said Andrade complained of pain, but was not taken to a hospital. An investigation is ongoing.

I wish the injured motorcyclist, John Madeiros, the very best for a speedy and complete recovery. I also hope Andrade did not sustain any serious injuries as a result of the crash. Sometimes, accident victims feel fine after the accident. It is not until hours or days after an accident that injuries such as whiplash, back injuries or internal injuries surface. If you have been in any type of vehicular accident, it is important that you get prompt medical attention so your doctor can determine that you haven't sustained any injuries.

Motorcycle Accident Statistics

According to CHP's 2008 Statewide Integrated Traffic Records System (SWITRS), there were no fatalities, but three injuries reported as a result of motorcycle accidents in Clearlake. In Lake County, three people died and 41 were injured as a result of motorcycle accidents in 2008.

Fault and Liability Issues

Based on this news report, it is not quite clear how or why Madeiros crossed over the double yellow lines and struck the other vehicle. Was this accident Madeiros' fault? Was there a vehicle defect or mechanical malfunction in the motorcycle? Was there a dangerous condition on the roadway, which caused or contributed to this crash? Were any other vehicles involved? For example, was Madeiros cut off by another motorist, which caused him to lose control of the Harley Davidson? I trust officials are examining these and other issues in order to determine what happened here and why.

In this particular case, if Madeiros is determined to have been at fault, he could financially responsible for Andrade's injuries. At the same time, if Andrade or any other motorist caused this accident, then they could be held liable for Madeiros's serious injuries. In such cases, an experienced San Francisco personal injury lawyer will help victims understand their legal rights and options.
