Man Severely Injured in Los Angeles Party Bus Accident

Namar Burton, 22, was injured in a Los Angeles bus accident when the party bus he was trying to catch ran him over. According to an Associated Press news report, the injury pedestrian accident occurred at McCadden Place and Yucca Street in Los Angeles the night of March 12, 2011. Burton was trying to catch the bus when it turned left and struck him. Burton is in grave condition after suffering severe injuries. An investigation is ongoing.

My thoughts and prayers are with Namar Burton and his family following this major injury bus accident. I wish him a complete and speedy recovery.

Los Angeles Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 104 people were killed and 2,716 were injured in Los Angeles pedestrian accidents. During the same year, there were 214 fatalities and 4,985 injuries reported as a result of Los Angeles County pedestrian accidents.

What Caused This Major Injury Accident

Based on this news report, the pedestrian was run over by the bus at the intersection when he was trying to catch the bus. It is not clear where he was at the intersection. If he was in a crosswalk, then, the bus driver should have yielded right-of-way to the pedestrian, under California law.

California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

If the bus driver is determined to have been at fault here, both, the driver and his or her employer, the bus company, can be held liable for the victims’ serious injuries.     Planning a big night on the town can turn into a big pain in the neck when more than a few people are involved.
