The Orange County Register reports that a driver of a Toyota pickup truck initially struck a parked Toyota Camry in the 900 block of Gilbert Street and then, fled the scene.<span id="more-1218"></span></p>
<p>As the suspect hit-and-run driver continued on Orange Avenue, he struck a Ford Focus, injuring its driver. The victim was transported to a local hospital. Officials said that his injuries were serious but not life-threatening. The driver of the pickup was arrested on suspicion of hit-and-run. Based on eyewitness accounts, he may also have been driving under the influence. Officials say he could face additional charges. </p>

The Daily Breeze reports that the contractor is likely to face several citations because they did not even have a permit to excavate that site. The worker was apparently standing on a plywood platform that was seated on the raised fork of a Caterpillar forklift, at a height of about 15 feet above the bottom of the hole. The worker had been using a hand-held tool to push down a steel pile when the vibration from the tool caused him to fall into the narrow hole. <span id="more-1215"></span></p>
<p>The worker asphyxiated to death as a large amount soil located next to the excavated trench, fell on him, officials said. His body was buried in the dirt for nearly five hours before emergency personnel could free it. The soil around the area was still unstable and moving, so the operation took several hours. The California Occupational Safety and Health Administration has issued a stop work order and is investigating this tragic incident.  </p>

<p><strong>Trenching Accidents</strong></p>
<p>Trench cave-ins are unfortunately common industrial accidents that cause death and <a href="http://www.bestattorney.com/catastrophic_injury.html" target="_blank">catastrophic injuries</a>. Over a five-year period, from 2001 to 2005, 26 Californians have been killed in trench collapse injuries and 207 injured in such incidents, according to CAL-OSHA’s Web site. In almost every instance of trench collapse, the cause was a failure to shore up the trench properly, the agency says.</p>

According to a Bay City News report, the driver of a 1998 Ford Mustang made a sudden lane change while traveling eastbound on Highway 80 in Emeryville. The Ford then struck another vehicle and came to rest facing oncoming traffic. This started a chain-reaction collision as a Nissan Frontier crashed head-on into the stopped Mustang, killing the driver of the Mustang. At least 12 cars were involved in this crash. According to a news report in The San Bernardino Sun, 19-year-old Ryan Inglesby ran a stop sign on Highway 62 while driving a 2005 Chevy pickup truck north on Sunset Road, in Joshua Tree. He then, broadsided a 1999 Dodge Caravan that went out of control and crashed through a fence. Matthews, the driver of the Dodge, was transported to a regional hospital in critical condition. Both Inglesby and his passenger, 22-year-old Cody Hommel, sustained minor injuries. Inglesby was arrested on suspicion of felony driving under the influence.<span id="more-1209"></span></p>

According to a news report in the Daily Breeze, police arrested 27-year-old Adriano Baek on suspicion of one count of gross vehicular manslaughter while intoxicated and two counts of DUI causing injury or death -- all felonies. <span id="more-1190"></span></p>
<p>California Highway Patrol officials say Baek was driving south on the 405 Freeway near the Crenshaw Boulevard off-ramp, in Torrance, when he attempted to merge into the fast lane. While doing so, Baek rear-ended the Ford van at a high rate of speed. The van driver lost control, went across two lanes of traffic and hit another vehicle driving in the slow lane. The van finally went down a steep embankment and crashed. The driver died at the scene and has not yet been identified.</p>

<p>The lawsuit claims that the 2003 Suzuki Grand Vitara manufactured and sold by the defendants had numerous auto defects that caused the death driver, Andrea Bardonner, after she was ejected from her vehicle and suffered <a href="http://www.bestattorney.com/catastrophic_injury.html" target="_blank">catastrophic injuries</a>.</p>
<p>Andrea was driving her 2003 Grand Vitara in July of 2006. She was headed east on Highway 16 in the Hamlet of Wildwood, Alberta, Canada. According to court records, Andrea's vehicle swerved and tumbled down a steep embankment, turning over many times and causing the roof to crush, the vehicle's pillars to give way, the seatbelt system to slacken and Andrea to be ejected from the car. She died on the scene and her daughters, Nichelle and Makayla, suffered severe, permanent permanent injuries.</p>
<p>John Bisnar of the Orange County Auto <a href="http://www.bestattorney.com/products_liability.html" target="_blank">Products Liability Law Firm</a>, BISNAR | CHASE comments, "We allege the 2003 Suzuki Grand Vitara Andrea was driving at the time of her death was plagued with a myriad of defects that ultimately caused her demise. These alleged and flagrant auto defects include, but are not limited to, a defective restraint system, a defective window system, insufficient strength and structural integrity to withstand <a href="http://www.bestattorney.com/roof_crush.html" target="_blank">roof crushing forces</a>, and insufficient lateral and roll stability. We contend the defendants knew about these defects yet they did nothing to warn Andrea, or the general public, about these defects."</p>
<p><strong>Auto Defects Were Known to Defendants</strong></p>
<p>Numerous papers and reports have been published since 1970, some of which were written by Ford researcher, Roger P. Daniel and the National Highway Traffic Safety Administration (NHTSA), have recommended safer car parts and frameworks that can prevent the ejection of occupants of vehicles. Mr. Daniel's report discussed at length the substitution of then current frameworks with metal framework and laminated glass or ejection resistant glazing, as the improved design provides a considerably better restraint system.</p>
<p>The lawsuit alleges that, despite these studies, Suzuki and the defendants failed to improve their vehicle's design which led to the ejection and death of Mrs. Bardonner during the <a href="http://www.bestattorney.com/van_rollover.html" target="_blank">roll-over crash</a>. Further, the lawsuit claims that the defendants were aware of the vehicle's deficiency in roll stability during upright cornering and handling and that the A and B pillars/windshield headers and roof rails were not structurally strong enough to withstand roof crush which could occur in minimal-impact accidents and lead to the injury of occupants.</p>
<p>The action also claims that defendants chose not to improve their vehicle's safety nor properly test the Grand Vitara's <a href="http://www.bestattorney.com/seatbelt_injury.html" target="_blank">seatbelt</a> performance during a rollover crash. The FMVSS 208 dolly rollover test, should it have been executed, could have the exposed seatbelt retractor defect the failed to lock and properly restrain Mrs. Bardonner during the fatal accident.</p>
<p>The action seeks economic damages for wrongful death, personal injuries, suffering, medical expenses, loss of earnings and earning capacity and loss of consortium on behalf of Andrea's family. Trial will be held in the Superior Court of California, County of Orange, case # 00109180. </p>
