Brianne Rodriguez, 16, was seriously injured in a Fresno area car accident after the vehicle in which she was a passenger rolled over. According to a news report in The Fresno Bee, the major injury crash occurred the night of June 5, 2011. Brianne Rodriguez was in the back seat of a Toyota Tacoma pickup truck driven by 18-year-old Alejandro Sepeda.
The pickup was traveling west on Avenue 184 in Porterville when Sepeda swerved to avoid a dog. The truck rolled over, went down an embankment and landed on the tree. A branch broke through the back window and impaled Brianne's leg. Sepeda sustained relatively minor injuries. Two other passengers -- Brittany Rodriguez and Priscilla Chavez, both 16 – sustained minor to moderate injuries. An investigation is ongoing.
My heart goes out to the injured victims of this car accident. I wish all the victims, especially the severely injured Brianne Rodriguez, the very best for a speedy and complete recovery. These victims will be in my prayers.
Car Accident Statistics
According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were four fatalities and 195 injuries involving car accidents in Porterville. In Tulare County as a whole, 65 people died and 1,724 were injured as a result of car accidents during the same year.
What Caused this Crash?
Based on this news report, it is not clear why Sepeda lost control of the vehicle. Was he traveling too fast at the time? Was there an auto defect or mechanical malfunction in the vehicle that may have caused or contributed to the crash? Was there a dangerous condition on the roadway? Was the driver of the Tacoma under the influence or driving recklessly? I trust officials are looking into these and other issues in order to determine what occurred here and why.
Fault and Liability
If Sepeda is determined to have been responsible for this car accident, then, he could be held liable for injuries suffered by the other passengers. Injured victims in such cases can seek compensation for medical expenses, lost wages, cost of hospitalization, rehabilitation and other related damages. If an auto defect or design flaw caused this rollover accident, then, the auto maker can also be held liable. An experienced Fresno personal injury lawyer will advise victims or their families about their legal rights and options.
