Teacher Injured in Orange County Car Accident Slowly Recovering

By Admin on November 19, 2009 - No comments

Kate Leavey, a middle school teacher in Irvine, has been identified as the victim of an Orange County car accident, which occurred when she was riding to school with her son and daughter the morning of November 16, 2009, The Orange County Register reports. Leavey sustained a skull fracture and multiple fractures to her limbs in this horrific accident, which occurred as she and her children crossed Irvine Center Drive and Yale Avenue. An eastbound car that was being driven by a 71-year-old man struck Leavey. Her children, thankfully, were uninjured. Leavey has stabilized since her accident, but is still in critical condition, according to family members.

Tough Times for a Local Family

My heart goes out to Kate Leavey and her family, which is obviously going through a tough time. It's heartwarming to see that the family is getting a lot of love and support from the community. I'm extremely relieved to hear that her two children are safe and came away from this serious bicycle accident, uninjured. I hope and pray Leavey makes and quick and complete recovery from her serious injuries. Leavey and her family will certainly be in my prayers.

Her family says Leavey is an avid bicyclist who rode with her children to school almost every day. Irvine police officials are still investigating the incident. The big question here is why did the driver crash into Leavey. I trust officials are looking into whether he was under the influence at the time. I also hope investigators are determining whether the driver was distracted, driving recklessly or otherwise negligent during this serious injury collision. Another important question in this accident is who had the right-of-way at the intersection. Who had the light at the time of the accident?

Who should be Held Liable?

If the driver is found to have been negligent, there is no question that he should be held civilly and criminally liable for this accident. Leavey will be able to seek compensation to help cover medical expenses, cost of hospitalization, physical therapy and other related costs. An experienced Orange County personal injury lawyer will also be able to advise them regarding filing a claim against the city of Irvine in the event a dangerous condition at that intersection is found to have caused or contributed to the collision.
