Sunnyvale Car Accident Possibly Caused by Speed, Stop Sign Violation

By Admin on July 18, 2010 - No comments

A Sunnyvale car accident left one woman dead and two others injured the morning of July 11, 2010. The San Jose Mercury News reports that a pickup truck crashed with a sedan at the intersection of Bernardo Avenue and Remington Drive. The pickup rolled over and the driver was ejected. All injured victims were taken to a local hospital for treatment.

I offer my deepest sympathies to the deceased victim's family and friends for their tragic and heartbreaking loss. They will be in my prayers.

Car Accidents

In Santa Clara County, 94 people died and 6,770 people were injured as a result of car accidents during 2008, according to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS). In Sunnyvale, there were five fatalities and 480 injuries involving car accidents in 2008.

Right-of-Way Laws

If the news report is accurate, authorities believe speed and a right-of-way violation may have played a part in this fatal collision. California Vehicle Code Section 22350 (Basic Speed Law) states: "No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic and on surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property." It is also illegal to run a stop sign under California Vehicle Code section 21802 (a).

Liability Issues

The family members of this deceased victim as well as the injured victims here would be well-advised to consult with an experienced San Francisco personal injury lawyer, who will examine all facets of the incident and determine fault and liability. If the driver of the sedan is determined to have been at-fault, he could be held liable for the female driver's wrongful death. He could also be held financially responsible for the injuries and losses sustained here by the passengers.

What are some precautions you would take as a motorist at a street intersection?
