Four people were injured, two seriously, in a San Francisco car accident, after two cars collided head-on, in Larkspur. According to a news report in the Marin Independent Journal, the accident occurred the night of December 13, 2009, when 53-year-old Fernando Lopez, who was heading east on Sir Francis Drake Boulevard, lost control of his 2001 Chevy Silverado, crossed over the double yellow line and into the westbound lane.
DUI Accident Causes Serious Injuries
The Silverado struck a 2008 Chevy Impala, before crashing into an embankment. The driver of the Impala, a 56-year-old woman sustained broken bones. Two passengers in the Chevrolet were hospitalized with serious injuries. Lopez suffered broken bones, but he was also arrested on suspicion of driving under the influence.
My heart goes out to the three injured victims who sustained serious injuries in this car accident. I hope none of them was catastrophically injured and wish them all the very best for a quick and complete recovery. They will certainly be in my prayers.
According to California Highway Patrol's 2007 Statewide Integrated Traffic Records System (SWITRS), 38 injuries were reported in Larkspur as a result of alcohol-related car accidents. In Marin County, three fatalities and 113 injuries happened due to alcohol-related car accidents in 2007.
California DUI Laws and Accident Liability
Driving under the influence of alcohol or drugs is a serious crime in California. According to California Vehicle Code Section 23152 (a): "It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle." The same code section also states that it is illegal for any person with a blood alcohol content of 0.08 percent or more to drive a vehicle.
Injured victims in such cases would be well-advised to consult a San Francisco personal injury lawyer, who has an excellent track record of pursuing drunk drivers or negligent drivers. A knowledgeable car accident lawyer should advise victims about how their car insurance will apply to an incident involving an uninsured or underinsured driver. Victims in drunk driving accidents may seek compensation to cover medical expenses, loss of earnings, cost of hospitalization, therapy and other related damages.
