The answers to these questions will hopefully help determine what caused the accident and who was responsible. If the truck driver was at fault, then both he and his employer could be held liable for Acosta-Alvarez's fatal injuries. In any traffic accident case, if there is negligence or wrongdoing involved, the family of the deceased victim can file a wrongful death claim seeking damages for funeral costs, loss of earnings and other related damages. If this car accident was Acosta-Alvarez's fault, then it would be necessary to look into whether the accident was caused by a product defect or mechanical malfunction. If that was the case, the auto maker could be held liable for his fatal injuries.
