San Diego Car Accident Injures School Bus Driver

By Personal Injury Lawyer on September 29, 2010 - No comments

One person was injured in a San Diego car accident on the Interstate 805 after a school bus was rear-ended by another vehicle. According to a 10news report, the bus was struck in the southbound lanes of the freeway near State Route 163, the morning of September 28, 2010. The bus then went off the roadway shoulder and crashed into a tree. One of the drivers was injured, but it is not clear which one. It appears that the school bus driver may have been injured because there was extensive damage to the front of the bus. Fortunately, there were no students on board. An investigation is ongoing.

My heart goes out to the injured victim of this crash. I wish the victim the very best for a speedy and complete recovery.

San Diego Car Accident Statistics

According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), 81 people were killed and 6,123 people were injured in San Diego car accidents. That same year, there were 246 fatalities and 13,527 personal injuries sustained in San Diego County car accidents.

What Caused This Car Accident?

It is unclear at this time what may have led to this car versus bus accident. Highway rear-end crashes often occur when one driver is following too close behind another vehicle or is distracted at the time.

According to California Vehicle Code Section 21703, "The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon, and the condition of, the roadway." California Vehicle Code Section 21704 also states that the driver "shall keep the vehicle he is driving at a distance of not less than 300 feet to the rear of any other motor vehicle subject to such speed restriction which is preceding it."

Liability Issues

If the driver of the car is determined to be at fault here, then he or she could be held liable for the school bus driver's injuries. Accident victims in such cases would be well advised to contact a knowledgeable San Diego personal injury lawyer, who will advise them about their legal rights and options.
