San Diego Car Accident Fatally Injures Marines

By Personal Injury Lawyer on March 27, 2010 - No comments

Two Marines, ages 19 and 21, sustained fatal injuries in a San Diego car accident after the vehicle they were in went off the roadway and into a ravine. The San Diego Union-Tribune reports that the fatal car accident occurred the night of March 18, 2010 when the Mazda 3 going west on Carroll Canyon Road in Mira Mesa went straight through a guardrail. Both men were buckled up and had to be extricated from the wreckage. Both were transported to a local hospital where they died.

My heart goes out to these young Marines' families, friends and fellow Marines. Please keep these grieving families in your prayers.

San Diego Car Accidents

There were 81 deaths and 6,123 injuries involving car accidents in San Diego, according to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS). Countywide, 246 people died and 13,527 were injured as a result of car accidents in 2008.

What Caused this Accident?

It is not clear what caused the Mazda to go through the guardrail. There is no indication from this news report that the driver was intoxicated, speeding, driving recklessly or distracted. However, is it important to look into whether a dangerous condition on that Mira Mesa roadway could have caused this tragic accident. Was there insufficient lighting in the area that prevented drivers from seeing that the road ended in a turnout? Were there signs on the street informing drivers that the roadway was ending in the turnout? How many accidents have occurred at that location over the last few years?

Liability Issues

An experienced San Diego personal injury lawyer will be able to explain to victims' families their legal rights and options in such cases. If this car accident was the result of a dangerous or defective roadway, then the city or governmental agency responsible for maintaining that roadway could be held liable. Any such claim against a governmental agency must be properly filed within six months of the accident or injury.
