A product liability wrongful death lawsuit has been filed against Ford Motor Company, Super Puente Hills Ford and Tuttle Click Ford, Inc. by the California auto defect lawyers of BISNAR | CHASE. The lawsuit claims that the defective Ford F250 manufactured and sold by Ford to Edward and Lois Bates is responsible for the catastrophic injuries sustained by Lois in a rollover crash that led to her death and for injuries sustained by Edward in the same accident.
"We allege the 2003 Ford F250 Super Duty pick-up truck driven by Lois's husband was wrought with a substantial amount of defects," said Brian Chase of the BISNAR | CHASE Auto Products Liability Firm "These defects, including an unsafe steering system, a weak roof design, a defective restraint system and a defective window system, caused Lois's tragic, untimely and unnecessary death. We contend the defendants knew about these defects and yet, acting in callous disregard, did nothing to warn Lois, or the public, about these defects."
Edward and Lois Bates were driving in their 2003 Ford F250 on June 23, 2007. Edward was the properly restrained driver, Lois the properly restrained front seat passenger. Suddenly, Edward found that their vehicle was swerving uncontrollably and he was unable to regain control before the F250, pulling a 2001 Road Runner 5th wheel behind the truck, veered into oncoming traffic, and rolled over numerous times. The rollover crash caused the roof to crush, allowing the vehicle's restraining system to collapse and allowing Lois to be unrestrained in the rolling vehicle. She died from catastrophic injuries on the scene.
Ford Has Received Complaints About Auto Defects Previously
The lawsuit alleges that the F250 Edward Bates was driving had many auto defects including unsafe steering which made the car oscillate uncontrollably, A and B pillars/windshield headers and roof rails that were of insufficient strength and poor structural integrity which caused the roof to crush and a faulty restraining system that failed to keep Lois safely restrained during the rollover crash.
Considering this is not the first instance of complaints Ford has received about their F250 model, the lawsuit alleges that Ford was well aware of many of their vehicle's problems, though they chose not to fix the defects nor warn the public. The suit also claims that information has been widely known and available since 1970 that shows the use of unsupported, tempered glass in side and rear windows, as was used in the F250 model, contributes to serious ejection problems in side and impact rollover accidents.
"We allege Ford failed to fix the inherent problems of its Ford F250 Super Duty pick-up truck based solely on the fact that it did not want to incur the expense required to make these modifications, a fact that is both callous and reckless to the health and safety of the general motoring public," said Chase.
The lawsuit is pending in the Superior Court of California, County of Orange, case # CIVVS 804173.
