Car Accident Causes
This news report offers very little information about exactly how or why this pedestrian accident occurred. If I were a family member of the victim here, I'd certainly want to find out why this collision occurred and also, if there was any negligence involved. Where exactly was the pedestrian walking at the time of the accident? Was he crossing the road, walking on a sidewalk or walking along the road? Did the driver fail to yield right-of-way to the pedestrian? Was the driver intoxicated, speeding, distracted or negligent in any other way? I trust police are looking into these and other factors to determine the cause of this serious injury accident.
Liability Issues
In such cases, it would be in the victim's best interest to consult with an experienced San Diego personal injury lawyer, who will stay on top of the official investigation and make sure that the negligent parties are held accountable. A skilled car accident lawyer will also determine whether a dangerous condition on the roadway led to this accident. If that was the case, the governmental entity responsible for maintaining that roadway can also be held liable. California Governmental Code 911.2 requires that claims against governmental agencies be filed within six months of the accident or injury. A knowledgeable injury lawyer will also be able to advise victims about how their own car insurance policy applies to a case where the at-fault party is uninsured or underinsured.
