The driver of a school bus was injured in a San Francisco car accident, which officials say, involved a suspected drunk driver. According to a news report in the Palo Alto Online, the collision occurred between a car and a school bus the morning of April 28, 2011. The suspected drunk driver, later identified as 20-year-old Alberto Cuellar, was southbound on Middlefield in Menlo Park when he collided with a northbound Sequoia Union High School District bus carrying 32 students. The children were not injured. The bus driver was hospitalized with complaints of neck and wrist pain. Cuellar was booked on suspicion of misdemeanor drunk driving, which could be elevated to a felony depending on the extent of the bus driver's injuries.
It is indeed fortunate that none of the students was involved in this school bus accident. I wish the school bus driver the very best for a speedy and complete recovery.
DUI Statistics
According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were no fatalities, but six injuries reported as a result of alcohol-related crashed in Menlo Park. In San Mateo County as a whole, eight people died and 251 were injured as a result of DUI collisions in 2008.
California DUI Laws
Driving under the influence of alcohol and/or drugs is illegal under California law. According to California Vehicle Code Section 23152 (a): "It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle." The same section also states that it is against the law to drive with a blood alcohol concentration of 0.08 percent or higher.
Liability Issues
In such cases, injured victims would be well-advised to contact a reputed San Francisco personal injury lawyer, who has the experience and track record of holding drunk drivers financially responsible. In this case, if the school bus driver was injured, he can claim compensation not only from the at-fault motorist, but also claim workers compensation from his employer since he was on the job.
