Personal injury lawyer in Orange CountyThree people were injured in a Newport Beach car accident, which involved two vehicles, the afternoon of June 19, 2011. According to a news report in The Orange County Register, the injury car accident occurred at the intersection of Pacific Coast Highway and Riverside Avenue. One of the vehicles overturned. Three people were transported to area hospitals with injuries. But, the extent of their injuries is not yet known. An investigation is ongoing.

My heart goes out to all the injured victims of this car accident. I wish them the very best for a speedy and complete recovery.

Car Accident Statistics

According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were six fatalities and 439 injuries reported in Newport Beach as a result of car accidents. During the same year, 152 people were killed and 13,414 were injured in Orange County car accidents in 2008.

Right-of-Way Issues

Based on this news report, it is not clear how or why this street intersection car accident occurred. Was impairment, distracted driving, speeding or inattention a factor in this crash? Did one of the drivers run a red light or fail to yield the right-of-way to the other vehicle?

California Vehicle Code Section 21453 (a) states: "A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown." Also, according to California Vehicle Code Section 21800 (a): "The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway."

Fault and Liability

In such cases the at-fault motorist can be held liable for the injuries and damages caused. Injured victims can seek compensation for medical expenses, lost wages, cost of hospitalization, rehabilitation and other related damages. Victims would be well-advised to contact an experienced Newport Beach personal injury lawyer, who will analyze all aspects of the incident and ensure that the negligent parties are held liable.

A skilled car accident lawyer will also be able to determine whether a dangerous condition at the intersection may have caused or contributed to the incident. If that was the case, the city or governmental agency responsible for maintaining that intersection can be held liable. Under California Government Code Section 911.2, any personal injury claim against a public entity must be properly filed within 180 days of the incident.
