Motorcyclist Fatally Injured in Orange County Car Accident

By Admin on January 3, 2010 - 2 comments

A 24-year-old motorcyclist who sustained fatal injuries in an Orange County car accident has been identified as David Tanner. The Orange County Register reports that the fatal motorcycle crash occurred the evening of December 29, 2009 at the intersection of Orangewood Avenue and Mac Nab Street when Tanner's Yamaha R1 motorcycle was struck by a BMW sedan, which turned left in front of him. Tanner was ejected from his motorcycle and then run over by a Ford Mustang.

My heart goes out to the family and friends of David Tanner for their devastating and sudden loss. I offer my deepest sympathies to everyone who knew and loved this man. This family will certainly be in my prayers.

Motorcycle Accident Statistics

There were 34 injuries in Garden Grove, California, as a result of motorcycle accidents in 2007, according to the California Highway Patrol's traffic accident statistics. Countywide, 24 deaths and 752 injuries occurred involving motorcycle accidents in 2007. Also, in Orange County, car accidents claimed 178 lives and injured 14,185 people during the same year.

California Car Accident Law

Based on this newspaper report, it seems to me that the driver of the BMW did not yield right-of-way to the motorcyclist who was going right through the intersection. According to California Vehicle Code Section 21801 (a): "The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety."

Claim for Compensation

If the driver of the BMW failed to yield right-of-way, then he or she should be held at-fault for this tragic accident. If I were a member of Tanner's family, I'd also want to know whether the driver of the BMW or the Mustang were under the influence, speeding, distracted or negligent in any other way. If there was a dangerous condition on this roadway, which may have caused or contributed to this accident, the city or governmental agency responsible for maintaining this roadway could also be held liable. Please remember that any claim against a governmental entity in California must be filed within 180 days of the accident or injury. I think this is a terrible way to end the year and I hope the driver is held accountable for his failure to yield that resulted in this young mans death. 24 is too young to go. David was just an aqquaintance of mine but I do know those who are deeply sadened by his death. May David Tanner R.I.P.

I was there as a witness, for the record, all drivers were drug tested and were cleared. This was a freak accident. There was a major investigation done by local PD. no one was speeding, no one was at fault. I am very sorry that a precious life of 24 year David was wasted. May David Tanner R.I.P.
I did not know you, but you touched my heart.
