Pedestrian Laws and Liability Issues
Based on this news report, there is very little information about how or why this fatal pedestrian accident occurred. There are several questions here. Who was at fault for the accident? Was the driver of the vehicle intoxicated, distracted, speeding or driving recklessly at the time of the collision? Was the pedestrian in a marked or unmarked crosswalk at the time?
California Vehicle Code section 21950 states: "The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection." The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk "shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian."
If the driver of the vehicle is determined to have been at fault for this crash, he or she could be held liable for the pedestrian's fatal injuries, as well as the injuries caused to the other occupants of the vehicle. An experienced Los Angeles personal injury lawyer will be able to better advise victims and their families about their legal rights and options.
