Two children and two adults sustained injuries in a San Diego car accident after one vehicle rear-ended another on the 5 Freeway in Oceanside. According to a news report in the North County Times, the injury collision occurred the afternoon of April 1, 2010 near Oceanside Boulevard, when a 1996 Toyota Camry carrying a 67-year-old woman and an 8-year-old boy, rear-ended a 2002 Lexus SUV occupied by a 60-year-old woman and an 11-year-old girl. California Highway Patrol officials say the driver of the Toyota did not see traffic slowing ahead and attempted to stop at the last instant, but it didn't help. The 11-year-old girl who was "in a lot of pain" was airlifted to an area hospital. The two adults and the boy sustained moderate injuries and were transported to a nearby hospital.
I sympathize with everyone who was injured in this accident especially the young children. I hope the girl did not sustain major injuries. I wish her and the other injured victims the very best for a speedy and complete recovery. Please keep them in your prayers.
Car Accidents
There were seven fatalities and 722 injuries involving car accidents in Oceanside in 2008, according to CHP's traffic accident statistics. In San Diego County as a whole, car accidents claimed 246 lives and injured 13,527 people during the same year.
Causes and Liability Issues
Based on this news report, it appears that the driver of the Toyota Camry may have been at fault for this horrific injury accident. Given that the Toyota rear-ended the Lexus at freeway speeds, it is fortunate that no one was killed. I trust officials are asking several questions here. Was the female driver of the Camry under the influence? Was she distracted by something? Was she simply not paying attention to the traffic ahead of her? If she is determined to have been at fault for this accident, she could be held financially responsible for the injuries caused.
In such cases, injured victims can seek compensation to cover medical expenses, cost of hospitalization, surgery, rehabilitation and other related expenses. An experienced San Diego personal injury lawyer will be able to advise injured victims about their legal rights and options, and will also, make sure that the negligent parties are held liable for their actions. A skilled car accident lawyer should advise victims about how their car insurance policy applies in a case where the at-fault driver is uninsured or underinsured.
