How Did this Accident Occur?
This news report does not offer much information about how or why this fatal car versus truck accident occurred. It is also not clear from this article, whether the car was stalled or stopped in traffic lanes or in the shoulder of the freeway. There are several questions here that need to be answered. Where exactly was the motorist stopped on the freeway at the time of the collision? Was the driver of the large truck impaired, fatigued, distracted or otherwise negligent? Was there a dangerous condition on the roadway, which may have caused or contributed to this fatal car accident? I trust the answers to these questions will help shed some light on what happened here and who was at fault.
Fault and Liability
If the big rig driver was at fault, the family of the deceased motorist can file a wrongful death claim against the driver as well as his employer. Such claims are filed by immediate family members and seek compensation to cover medical or funeral expenses, lost future earnings, loss of love and companionship, and other related damages.
