A driver was fatally injured in a San Diego car accident, after being rear-ended by a suspected drunk driver at a busy intersection the night of December 13, 2009. According to an NBC news report, the fatal car accident occurred at the intersection of Genesee Avenue and North Torrey Pines Road in San Diego. Police say a 30-year-old man driving an Infinit rear-ended a Volkswagen that was driving on Torrey Pines. The force of the collision caused the Volkswagen to burst into flames. The driver of the Volkswagen, who has not yet been identified, died at the scene. The driver of the Infiniti was uninjured and was arrested on suspicion of driving under the influence and vehicular homicide. His passenger sustained minor injuries.
I offer my deepest condolences to everyone who knew and loved this man, who died so tragically as a result of another's negligent actions. Please keep this grieving family in your prayers.
Alcohol-Related Car Accidents in San Diego
There were 41 deaths and 894 injuries involving DUI car accidents in the city of San Diego in 2007, according to California Highway Patrol's 2007 Statewide Integrated Traffic Records System (SWITRS). In San Diego County, drunk driving car accidents claimed 116 lives and injured 2,068 during the same year. It is interesting to note that both, in the city of San Diego and countywide, DUI accident fatalities accounted for nearly half of all traffic accident deaths in 2007.
The article states that the impact from the rear-end collision was so forceful that officials are looking into whether the driver of the Volkswagen died as a result of the initial impact or due to the fire. There is no question that the negligent driver here, should be held criminally and civilly responsible for the death. Drunk driving is a serious crime in California.
California DUI Laws
California Vehicle Code Section 23152 (a) states: "It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle." In these types of fatal car accidents, it would be in the best interests of the victim's family to seek the counsel of a reputed San Diego personal injury lawyer, who has an excellent track record of holding negligent and drunk drivers accountable. Where negligence or wrongdoing is involved families of deceased car accident victims can file wrongful death claims seeking compensation to cover funeral expenses, loss of earnings, loss of love and companionship and other related damages.
