Pedestrian Injured in DUI Collision

By Personal Injury Lawyer on January 28, 2011 - No comments

Police officer Bobby Daniels, 47, was seriously injured in a Sacramento area car accident, which officials say, involved a driver under the influence of alcohol. According to a news report in the Rocklin & Roseville Today, the injury accident occurred on Fairway Drive at Blue Oaks Boulevard in Roseville the afternoon of January 22, 2011. Ilia Arthur Wong, 20, lost control of his 1993 Jeep SUV while making a turn and ended up striking Daniels on the sidewalk. The off-duty Sacramento police officer sustained major injuries. Wong has been arrested for DUI causing injury.

My thoughts and prayers are with Officer Bobby Daniels following this pedestrian accident. I wish him a complete and speedy recovery from his injuries.

DUI Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), three people were killed and 62 were injured in Roseville DUI collisions. During that same year, there were 10 fatalities and 190 injuries reported due to alcohol-related car accidents in Placer County.

Drunk Driving Laws in California

Based on this news report, the victim, Daniels, was walking on the sidewalk at the time of the accident. Police say that the driver was under the influence of alcohol when he lost control of his vehicle. According to California Vehicle Code 23152 (a): "It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle." The same section also states that it is illegal to drive with a blood alcohol level of 0.08 percent or higher.

Liability Issues

The victim of an accident caused by a drunk driver may pursue financial compensation for their losses by filing a personal injury claim. DUI offenders may not only be criminally prosecuted, but also held civilly liable for medical expenses, lost wages, and other related damages. Car accident victims would be well-advised to seek the counsel of a reputed Sacramento personal injury lawyer, who has a successful track record of holding drunk drivers financially responsible for victims' injuries and damages.
