Two people were injured in a Ventura car accident the morning of August 27, 2009. According to a news report in the Ventura County Star, the car collision occurred near the intersection of East 5th Street and Rice Avenue in Oxnard, California. When the initial two-car accident occurred, one man was trapped in his pickup that had been pushed on to nearby railroad tracks. One person was injured in the other vehicle. A Metrolink train then came through the intersection and hit the vehicle that was left on the tracks, Oxnard fire officials said.
Firefighters apparently freed the crash victim just moments before the train hit the stranded vehicle. Both victims were transported to a local hospital. Their injuries were not life-threatening. No one on the train was injured either. It is indeed fortunate firefighters responded when they did and were able to extricate the victim before the train-car collision.
I'm relieved that neither of the two victims in this
California car accident suffered life-threatening injuries. I wish them the very best for a quick and complete recovery. The Oxnard firefighters have done a marvelously heroic job pulling out the trapped man seconds before the oncoming train, at great peril to their own lives.
Ventura Car Accident Statistics
According to California Highway Patrol's 2007 Statewide Integrated Traffic Records System (SWITRS), 13 fatalities and 1,105 injuries involving car accidents were reported in Oxnard, California. In Ventura County as a whole, there were 71 deaths and 3,993 injuries in 2007 as a result of car accidents.
In this case, it is important to look into how the initial car accident involving the two cars occurred. Since it happened at an intersection, it would be logical to look into who had the right-of-way at the time. The driver who did not have the right-of-way, in such cases, could be held at fault for the accident and liable for the victim's injuries, loss and damages. Car accident victims are usually able to seek compensation to cover medical expenses, loss of earnings and even the cost of long-term care if the accident resulted in major injuries.
California Car Accident Lawyer
Victims in such cases would be well-advised to contact an experienced California personal injury lawyer who will not only stay on top of the investigation, but also help determine whether there was any negligence here. A skilled California car accident lawyer will also look into whether a dangerous condition on the roadway or the railroad caused or contributed to this accident. If that was the case, the governmental agency or entity responsible for maintaining that roadway could be held liable. In California, any claim against a governmental agency must be filed within six months of the accident or injury.
