Baldwin Park dog bite attorneys photoDog attacks can be physically and emotionally traumatizing for victims. Often, health insurance does not pay for cosmetic procedures, which dog bite victims often require. If a dog bite incident occurred as the result of a dog owner's negligence, then, the owner of the vicious dog can be held liable for the victim's injuries, damages and losses. If you or a loved one has been injured in a dog attack, an experienced Baldwin Park dog bite lawyer can help you better understand your legal rights and options.

Dog Bite Statistics

According to a statistics gathered by victims advocacy group, DogsBite.org, California and Texas led all states with four dog-related fatalities in the year 2011. Pit bulls accounted for 88 percent of all fatal attacks in those states. In fact, pit bulls and rottweilers accounted for 84 percent of all fatal dog attacks in the United States that year. From the year 2005 to 2011, pit bulls and rottweilers accounted for 156 of the total 213 fatalities suffered in dog bite incidents. Pit bulls were involved in 127 of those fatal incidents. A review of the numbers shows that pit bulls were involved in 71 percent of all dog bite attacks in the year 2011 despite only making up five percent of the U.S. dog population.

According to The U.S. Centers for Disease Control and Prevention (CDC), approximately 800,000 Americans need medical attention as the result of dog bites each year. About half of those victims are children. Of the injured victims, approximately 386,000 require emergency medical attention and 16 are fatally injured.

California Dog Bite Law

Victims of dog bite injuries can pursue compensation for their losses by filing a claim against the dog owner under California's "strict liability statute." California’s Civil Code Section 3342 states: "The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness."

Injuries Suffered in Dog Attacks

Injuries suffered in a dog attack may often require immediate medical attention. Anyone who is bleeding or bruised from a dog bite should see a doctor right away. Surgery may be needed to repair the skin and testing for rabies may be required as well. There are many injuries that can be suffered in a Baldwin Park dog attack, including:

  • Lacerations: A powerful bite or deep scratch can easily break the skin. When these injuries are on the wrist or neck, the victim can lose a substantial amount of blood. When they are on the face, they can result in permanent disfigurement.
  • Broken bones: Some dogs are so strong that they can actually shatter bones with their jaws. Victims of severe bites can suffer bone fractures in their hand, wrist or forearm. Children are particularly at risk.
  • Nerve damage: When there is severe skin damage, there is also the potential for nerve damage to occur. In such cases, the victim may permanently lose feeling or physical ability.

All of these of injuries require expensive medical treatments. It is common for victims of dog bite injuries to require surgical procedures that are not covered by medical insurance. Compensation may be available, however, if the victim chooses to file a personal injury claim against the dog owner. Unfortunately, it is common for insurance companies to deny valid claims or for dog owners to deny responsibility for the actions of their pets. The owner of a dangerous dog can be held accountable for the victim’s medical bills, pain and suffering, hospitalization costs, lost wages, lost future wages and other related damages.
