Hurt on the job - What are my rights?

— An on-the-job injury is an injury suffered by an employee while working. On-the-job injuries can occur by accident, injury or occupational disease and may be covered by Workers' Compensation laws, tort law or both. Workers' Compensation laws provide benefits to workers and their dependents when they have suffered injury or death arising out of a work environment.

— These benefits include medical benefits, weekly or biweekly income, vocational rehabilitation, permanent disability compensation and death benefits. These benefits, in cases of serious injuries, may be substantially lower than the injured worker is entitled to under tort law. However, under California law, an employee is precluded from suing the employer for on-the-job injuries in nearly all situations. But, if your employer willingly or recklessly caused your injury you may be entitled to compensation. If you decide to sue your employer you will waive your rights to Workers Comp.

— In cases where an employee has sustained an on-the-job injury caused by someone other than the employer, the injured employee may sue such other person (third party) in tort law. What if my employer stops me from filing for Calif Workers Comp?

Workers compensation laws prohibit your employer from forbidding you to exercise your right to their Workers Comp benefits. If you are being bullied into not filing a claim for an on the job injury be sure to contact your benefits administrator and file a report with your Workers Comp representative.

Keep notes of what has transpired in regards to your employer refusing access to Workers Comp. These notes will be critical in proving that you sought help after an on the job injury and were declined.
