Fullerton Police Chief's Statements Clears Homeless Man of Wrongdoing

The Orange County law firm of Bisnar | Chase, which represents families of wrongful death victims, welcomes the Fullerton police chief's decision to publicly proclaim the innocence of Kelly Thomas, a homeless man who, according to court records (Case # 11CF2575), was beaten to death by the department's officers on July 5, 2011. All charges are pending against the two police officers (Case # 11CF2575) and according to the Orange County District Attorney's website, a preliminary hearing on the matter has been scheduled for Nov. 30 at 9 a.m. at the Central Justice Center in Santa Ana.

According to a Sept. 18 news report in The Orange County Register, acting Fullerton police chief made a statement during a council meeting stating that Thomas was not attempting to steal items and was not in possession of stolen property when officers confronted him. The chief also confirmed that one of the officers did not suffer fractured ribs during the altercation, but "strained ribs," the report stated. Kelly Thomas died from the severe brain injuries he suffered during the incident, according to court documents. His family and several members of the public have demanded an admission from the Fullerton police department that Thomas had not committed a crime or was not looking to commit a crime just before the police encounter, the Register reports.

"It is challenging for police departments to handle cases where acts of neglect or wrongdoing are alleged against their own," Bisnar said. "In such cases, whether it is a car crash or a violent incident, it is imperative that third parties are brought in to conduct an independent investigation and determine the facts."

In cases where individuals are killed or suffer catastrophic injuries as a result of someone else's negligence or wrongdoing, families of the deceased victims can file a civil wrongful death lawsuit against the at-fault parties. California Code of Civil Procedure Section 377.60 defines wrongful death as "the death of a person caused by the wrongful act or neglect of another." (California Legislative Counsel)

"When a family loses a loved one suddenly due to another party's neglect or wrongdoing, the emotional pain increases exponentially," Bisnar said. "Especially, in this case, the family has no sense of closure. When the incident involves unanswered questions or when there is ambiguity surrounding the victim's death, it can be extremely challenging for family members to deal with their grief and loss."
